| Abstract | ||||
| ملخص البحث: موضوع البحث: يتحدث البحث عن الشبهات في علم أصول الفقه، والرد عليها، وكيف دافع الأصوليون عن تلك المباحث في الكتاب والسنة النبوية، وإجماع الصحابة y، والقياس وغيرها من مباحث أصول الفقه المتعلقة بباب الأدلة الشرعية. أهداف البحث: يهدف البحث إلى إبراز أجوبة الأصوليين في الدفاع عن مصدر استنباط الأحكام الشرعية، وهو علم أصول الفقه، ودرء الشبهات في باب الأدلة الشرعية، حتى يبقى هذا العلم نقيًّا صافيًا في إبراز قواعد الاستنباط التي يحتاج لها الفقيه؛ لإخراج الأحكام الشرعية العملية التفصيلية، فيستفيد بها المسلمون في عبادتهم لربهم جل وعلا. المنهج المتبع في البحث: هو المنهج الاستقرائي التحليلي، باستقراء كتب الأصوليين، وتتبع أقوالهم حول أهم الشبهات في باب الأدلة الشرعية، مع تحليل تلك الشبهات من خلال عرض الأقوال الأصولية؛ للوصول إلى نتائج علمية حول تلك الشبهات، وتفنيدها ودحضها أمام أدلة الكتاب والسنة. أهم نتائج البحث: أن لعلم أصول الفقه مكانة عظيمة بين العلوم الإسلامية، وليست محصورة فقط على جانب استدلال الأصوليين للأحكام الفقهية، بل مجالات كثيرة متعددة منها أنه حصن في الدفاع عن الإسلام ضد أعدائه المتربصين به، مع بيان أن الموضوع لا زال بحاجة إلى عرضه في أطروحة ماجستير أو دكتوراه؛ لاستكمال كل الشبهات في جميع أبواب أصول الفقه الأخرى إن شاء الله تعالى. Abstract: Research Topic: This research examines the doubts in the science of Usul al-Fiqh (the principles of jurisprudence), how to respond to them, and how the scholars of Usul al-Fiqh defended these topics in the Qur'an and the Prophetic Sunnah, the consensus of the Companions (may Allah be pleased with them), analogy (qiyas), and other Usul al-Fiqh topics related to the chapter of Shari'a evidence. Research Objectives: This research aims to highlight the answers of Usul al-Fiqh scholars in defending the source of deriving Shari'a rulings, namely Usul al-Fiqh, and to ward off doubts regarding Shari'a evidence. This will ensure that this science remains pure and clear in highlighting the rules of deduction required by the jurist to produce detailed practical Shari'a rulings, which Muslims can benefit from in their worship of their Lord, the Almighty. Research Methodology: This research uses the analytical inductive approach, examining the books of Usul al-Fiqh scholars and tracing their statements on the most important doubts regarding Shari'a evidence. It also analyzes these doubts by presenting the Usul al-Fiqh opinions to arrive at scientific conclusions regarding these doubts and refute and disprove them in light of the evidence of the Qur'an and Sunnah. The most important findings of the research: The science of Usul al-Fiqh holds a significant position among Islamic sciences. It is not limited to the reasoning of legal scholars for jurisprudential rulings, but rather encompasses many diverse fields, including its role as a bulwark in defending Islam against its lurking enemies. It should be noted that the subject still needs to be presented in a master's or doctoral thesis to address all the doubts raised in other Usul al-Fiqh chapters, God willing. | ||||
