| Abstract | ||||
| ملخص البحث: لهذا البحث هدف رئيس هو رصد أهم آثار الدولة القانونية في تطوير فقه النظام السياسي الإسلامي المعاصر، وفي سبيل تحقيق هذا الهدف وضحت الدراسة ماهية الدولة القانونية، وعرضت لأهم مقوماتها، ودللت على قدرة النظام السياسي الإسلامي على التفاعل الإيجابي مع هذه الدولة والتأصيل لهذه المقومات واستيعاب الكثير منها، ثم عرضت في مبحثين متواليين لأهم آثار الدولة القانونية في تطوير فقه النظام السياسي الإسلامي بناء وأداء. واستخدمت الدراسة المناهج الآتية: الوصفي والتحليلي والاستنباطي والمقارن. وخلصت الدراسة إلى عدد من النتائج، منها: أن للدولة القانونية أثرها الواضح في تنبيه العقل المسلم على الإمكانات الهائلة المعطلة في الإسلام، واستنفار الحركة الفقهية المعاصرة للقيام باستلهام الوحي الشريف واستخراج قيم النظام السياسي الإسلامي من نصوصه ومبادئه وقواعده الكلية ومقاصده العامة، وأن الخصومة بين الدولة في الإسلام والدولة القانونية خصومة مفتعلة في كثير من النقاط، وأن الدولة في النظام السياسي الإسلامي أحق ما توصف بالدولة القانونية؛ وقد تفاعل العالم الإسلامي مع الدولة القانونية على المستوى التطبيقي تفاعلا إيجابيا، وبينت الدراسة أن النطاق الرئيس الذي يظهر فيه أثر الدولة القانونية هو استحداث آليات ووسائل زمانية ومكانية لإدارة الشأن العام، وقد نجحت الحركة الفقهية المعاصرة في تحليل هذه الآليات والوسائل تحليلا عميقا، والوقوف على مدى العمل بكل واحدة منها في ضوء كليات الشريعة ومقاصدها، وأسفر ذلك عن قبول الكثير من هذه الآليات والوسائل، وكشفت الدراسة عن أن صعوبة الوقوف على معالم الدولة القانونية في المصادر الإسلامية راجع إلى وجود اختلاف كبير في الاصطلاحات، واختلاف ترتيب المسائل في مدوناتنا الفقهية عن الصياغات القانونية المعاصرة، والفصل بين دراسة الشريعة والعلوم السياسية والقانونية. وتوصي الدراسة بإجراء المزيد من البحوث والدراسات لرصد أثر الدولة القانونية على المصطلحات والآراء في الفروع الفقهية القانونية الأخرى. Abstract: The main goal of this research is to monitor the most important effects of the legal state in the development of the jurisprudence of the contemporary Islamic political system, and in order to achieve this goal, the study explained the essence of the legal state, presented its main elements, demonstrated the ability of the Islamic political system to positively interact with this state, root these elements and absorb many of them, and then presented in two consecutive discussions the most important effects of the legal state in the development of the jurisprudence of the Islamic political system. The study used several research methods: Description and analysis and conclusions and comparisons. The study concluded with a number of results, including: that the legal state has a clear effect in alerting the Muslim mind to the enormous potential of Islam, and prompting the contemporary jurisprudential movement to take the initiative of the honorable revelation and extract the values of the Islamic political system from its text, principles, rules and general purpose, and that the conflict between the state in Islam and the legal state is in many respects, and that the state in the Islamic political system cannot be described as a legal state; The Islamic world interacted with the legal state at the applied level in a positive way, and the study showed that the main area in which the effect of the legal state is manifested is the creation of mechanisms and means of temporal and spatial management of public affairs. In the Islamic sources, this is due to the existence of a significant difference in terminology, and the difference in the order of the questions in our jurisprudential texts from contemporary legal texts, and the separation between the study of Shari'ah and the political and legal sciences. The study recommends conducting more research and studies to monitor the impact of the legal state on terms and opinions in other legal jurisprudence branches. | ||||
