| Abstract | ||||
| ملخص البحث: تميزت الشريعة الإسلامية بالشمولية في أحكامها كافة؛ حيث إنها تعالج مبادئ الإسلام وقواعده كل ما ينفع الناس في الدنيا، وتضمن لهم حسن الجزاء في الآخرة، وهذه الشمولية تُعد منهجًا متكاملًا لجميع مظاهر النشاط الحيوي للفرد والمجتمع، وجميع علاقات الإنسان، وجميع جوانب حياته، ولذا فهذا المنهج صالحًا وشاملًا للبشرية في نظم الحياة كافة، واختص هذا البحث بالنظام الاجتماعي، وأبرز قضاياه التي تمس مصالح الفرد والمجتمع من منظور الثقافة الإسلامية، وكيفية معالجتها، ومقارنة هذه الموضوعات بالقانون الغربي، لما لها من أهمية كبيرة لارتباطها بقضايا النظام الاجتماعي بالأسرة والتي تؤثر على الافراد والمجتمع، كما تُعد قضايا النظام الاجتماعي من أهم القضايا التي تشغل المجتمعات المعاصرة، وقمت بتقسيمه إلى: مقدمة، وتمهيد، وثلاثة مباحث، وخاتمة، فالمقدمة: اشتملت على أهمية الموضوع، وأسباب اختياره، وأهداف البحث، ومشكلة البحث والتساؤلات، ومنهج البحث، والدراسات السابقة، وخطة البحث، ثم قمت بتعريف النظام الاجتماعي في الفكر الإسلامي، والفكر الغربي، ثم تناولت بعضًا من أحكام الشريعة التي لها تعلق بالنظام الاجتماعي موضحًا إياها في التشريع الإسلامي والقانون الغربي، كالطلاق، وما تميز به التشريع الإسلامي عن القانون الغربي في جانب الطلاق، ثم الخلع في الشريعة الإسلامية والقانون الغربي، وما تميز به التشريع الإسلامي عن القانون الغربي في الجخلع، ثم ألقيت الضوء على مسألة تعدد الزوجات في الشريعة الإسلامية والقانون الغربي، وما تميز به التشريع الإسلامي عن القانون الغربي في تعدد الزوجات، ثم ختمت البحث بخاتمة اشتملت على أهم النتائج والتوصيات، وذيلته بفهارس توضيحية. Abstract: Islamic Sharia is characterized by the comprehensiveness of all its provisions. As it addresses the principles and rules of Islam, everything that benefits people in this world, and guarantees them a good reward in the hereafter, and this comprehensiveness is considered an integrated approach to all aspects of the vital activity of the individual and society, all human relationships, and all aspects of life. Therefore, this approach is valid and comprehensive for humanity in all life systems. This research is concerned with the social system, and its most prominent issues that affect the interests of the individual and society from the perspective of Islamic culture, and how to address them, and compare these topics with Western law, due to their great importance due to their connection to issues of the social system in the family that affect individuals and society. Also, issues of the social system are among the most important issues that occupy contemporary societies. I divided it into: an introduction, a preface, three chapters, and a conclusion. The introduction included the importance of the topic, the reasons for choosing it, the objectives of the research, the research problem and questions, the research methodology, previous studies, and the research plan. Then I defined the social system in Islamic thought and Western thought, then I addressed some of the provisions of Sharia that are related to the social system, explaining them in Islamic legislation and Western law, such as divorce. What distinguishes Islamic law from Western law in the area of divorce, then Khul’ in Islamic law and Western law, and what distinguishes Islamic law from Western law in Khul’, then I shed light on the issue of polygamy in Islamic law and Western law, and what distinguishes Islamic law from Western law in polygamy, then I concluded the research with a conclusion that included the most important results and recommendations, and I supplemented it with explanatory indexes. | ||||
