| Abstract | ||||
| ملخص البحث: هدفت الدراسة الكشف عن وسائل الاثبات من خلال المقارنة بين الشريعة الاسلامية والقانون، تم استخدام المنهج الوصفي التحليلي، والمنهج المقارن، وقد انتهت الدراسة إلى عدد من النتائج والتوصيات، حيث كان من أبرز النتائج؛ هناك توافق بين فقهاء الشريعة الإسلامية في تعريفهم للإقرار، من حيث مضمونها سيما مع المذهب الحنفي وكون هذا المذهب هو احد مصادر القانون المدني الأردني الذي يعتبر مصدراً ايضاً لقانون البينات، وقد أوصت الدراسة بضرورة العودة لدراسة الشريعة الإسلامية والاستفادة من الكنوز الكامنة في أعماق هذه الشريعة، ودراسة آراء فقهاء الإسلام ونظرياتهم حول الإثبات كي يتم تطعيم منظومة العدالة بالفكر الإسلامي جنباً إلى جنب مع منظومة القوانين المعاصرة، كما يوصي الباحث بعقد المؤتمرات العلمية التي تجمع بين كبار رجالات العلم ومنظومة العدالة للتواصل بينهم وتقديم الأبحاث المهمة في شأن وسائل الإثبات والنظريات التي من شأنها اضافة الكثير الى منظومة العدل والقضاء، وأيضا العودة الى التمسك بالنصوص القانونية وجعلها أكثر قوة والزاماً. Abstract: The study aimed to reveal the means of proof through comparison between Islamic Sharia and law. The descriptive analytical approach and the comparative approach were used. The study concluded with a number of results and recommendations, the most prominent of which were: There is agreement among Islamic Sharia scholars in their definition of acknowledgment, in terms of its content, especially with the Hanafi school of thought, and the fact that this school of thought is one of the sources of Jordanian civil law, which is also considered a source of evidence law. The study recommended the necessity of returning to the study of Islamic law and benefiting from the treasures hidden in the depths of this law, and studying the opinions of Islamic jurists and their theories about proof in order to inoculate the justice system with Islamic thought alongside the system of contemporary laws. The researcher also recommends holding academic conferences that bring together leading figures in science and the justice system to communicate and present important research on means of proof and theories that would significantly contribute to the justice and judicial system. He also recommends reaffirming adherence to legal texts and making them more powerful and binding. | ||||
