| Abstract | ||||
| يتناول هذا البحث دراسة الآثار الدولية المترتبة على المبيعات القضائية للسفن في ضوء اتفاقية الأمم المتحدة، المعروفة باتفاقية بكين. وقد انضمت المملكة العربية السعودية إلى هذه الاتفاقية بهدف إرساء نظام دولي موحد يعترف بالبيع القضائي للسفن ويضمن نفاذه في الدول الأطراف، مع المحافظة على التشريعات الوطنية المنظمة لإجراءات البيع. أهداف البحث تمثلت في السعي لإنشاء نظام قانوني يعترف دوليًا بملكية المشتري بعد البيع القضائي، وضمان اليقين القانوني خلال الملاحة الدولية، إلى جانب رفع العائدات المحصلة من عمليات البيع، وتعزيز التجارة البحرية العالمية. منهج البحث اعتمد على المنهج الوصفي التحليلي، من خلال عرض نصوص الاتفاقية ومضامينها وتحليل آثارها القانونية، مع بيان الإجراءات القضائية المتعلقة بإصدار شهادة البيع القضائي، وتنفيذ تسجيل السفينة أو شطبها في سجلات الدول الأطراف. توصل البحث إلى نتائج مهمة، أبرزها: أن البيع القضائي الصادر في دولة طرف يمنح المشتري ملكية خالصة للسفينة، وينبغي الاعتراف بهذه الملكية تلقائيًا في بقية الدول الأطراف دون الحاجة لإجراءات إضافية. كما يُمنع حجز السفينة لاحقًا على أساس ديون سابقة للبيع، وتُمنح محاكم دولة البيع القضائي اختصاصًا حصريًا لإبطال البيع. أما التوصيات، فشملت حث الدول على الانضمام إلى الاتفاقية لتوسيع نطاق نفاذها، وتبني آلية إلكترونية موحدة لإخطار المالكين والدائنين، وضمان إصدار شهادات بيع قضائي وفق نموذج موحد معتمد. كما أوصى البحث بضرورة احترام السيادة القضائية لكل دولة، مع تعزيز الاعتراف المتبادل بالإجراءات القضائية بين الدول الأطراف. This research explores the international effects of judicial sales of ships under the United Nations Convention, known as the Beijing Convention. The Kingdom of Saudi Arabia has acceded to this Convention to contribute to the establishment of a unified international legal framework that ensures the effectiveness and recognition of judicial sales across all State Parties while preserving domestic legislative frameworks governing judicial procedures. The objectives of the study include creating an internationally recognized system for conferring clear title to purchasers of ships through judicial sales, ensuring legal certainty in cross-border navigation, increasing sale revenues for creditor distribution, and enhancing global maritime trade. The methodology employed in this research is descriptive and analytical. It presents the core provisions of the Convention, analyzes their legal impact, and addresses judicial procedures for issuing a Certificate of Judicial Sale, as well as procedures for deletion or registration of vessels in the ship registries of State Parties. The key findings include the affirmation that a judicial sale conducted in a Contracting State, which grants the purchaser clean title, shall have the same effect in all other Contracting States without the need for further judicial validation. The Convention prohibits any subsequent arrest of the ship based on pre-existing claims and vests exclusive jurisdiction in the courts of the State of judicial sale to annul such a sale. The recommendations emphasize encouraging further accession to the Convention to enhance its global application. It proposes the adoption of a unified digital platform for notifying shipowners and creditors, standardized issuance of Judicial Sale Certificates, and the need to respect the judicial sovereignty of each State. Furthermore, the study calls for promoting mutual recognition of judicial procedures among State Parties to foster legal stability and trust in international maritime transactions. | ||||
