| Abstract | ||||
| يدور البحث حول حكم طلب الزوجة نفقة خاصة في الفقه الإسلامي، من خلال تناوله لمسألة معاصرة في هذا الباب؛ وهو: طلب الزوجة من زوجها راتبا خاصا بها، في زمن منفق عليه، شهريا أو ربع سنوي ونحو ذلك، وهل هو داخل في النفقة الواجبة إذا لم يكن شرطاً في العقد، وتم تناول هذا الموضوع من خلال ثلاثة فصول وخاتمة بعد المقدمة، تحدثت في فصله الأول، على التعريف ببعض المصطلحات الواردة في العنوان، ثم اشرت إلي حكم النفقة على الزوجة، وعقدت الفصل الثاني لبيان الشروط الصحيحة والفاسدة في العقد وأجملت الشروط في النكاح في الجملة في تقسيم يسع المذاهب الأربعة مع دراسة بعض مسائل الخلاف فيه، ثم عقدت الفصل الثالث عن صورة المسألة وهو طلب المصروف الشهري من الزوجة وما يتعلق به من أحكام في كلام الفقهاء، ثم خرجت بنتائج مهمه ومنها: أن شرط الزوجة على زوجها نفقة زائدة -كالراتب الشهري-في العقد، هو شرط صحيح عند جمهور العلماء، ويسن الوفاء به. أن طلب الزوجة نفقة زائدة من غير اشتراط لا يجب على الزوج بزله الا إذا اقترن بعرف سابق للزوجة، فيكون من كفايتها عرفاً. أن عدم التزام الزوج بالشروط الصحيحة لا يفسد العقد وإنما يجعل للزوجة الخيار. لا يفرق بين الزوجة العاملة وربة المنزل في كل ما ذكر وختمت البحث بفهرس للمصادر والمراجع. Abstract Praise be to Allah and peace and blessing upon the Noble Prophet: The Paper revolved around the ruling of the wife requesting a personal maintenance in the Islamic jurisprudence, through the discussion of thea contemporary issue on this matter, which is: the monthly quarterly etc. could this be considered a part of the compulsory maintenance if it was not part the condition of their marriage? This issue was discussed in three sections and conclusion, after the introduction. The first section includes the definition of some terminologies in the title, then pointing to the ruling of the explication of the acceptable and the unacceptable conditions in marriage contract, and the additional condition in marriage were summarized in a division that cuts across all the four classical schools of Islamic jurisprudence with a study of some disputed issues therein then the third section focused on the conceptualization of the issue which is the wife`s request of monthly payment from the husband and the related rulings from the opinions of the jurists, this was followed by the significant findings of the search which include: That the wife giving her husband the condition additional maintenance –like a monthly salary- in the marriage contract, is an acceptable condition according to the majority of the scholars, and it is recommended that is fulfilled. That the wife`s request of an additional maintenance without a prior condition would not make it`s payment binding on the husband unless there is a precedent of custom regarding the wife, hence making it part of here customary sustenance. That the husband`s non-fulfilment of the acceptable conditions does not invalidate the marriage contract, it would only give the wife the discretion of choice vis-à-vis staying in the marriage of leaving. There should be no difference between working wife and an house wife regarding all that have beem mentioned. The paper was concluded with the bibliograbhy.
