| Abstract | ||
| يعني هذا البحث بدراسة التغليب الفقهي, كأحد معللات انتقال الحكم من مسألة لأخرى في الفقه الإسلامي, وذلك ببيان معناه وأركانه وشروطه ومظانه. ويسعى هذا البحث للكشف عن المسائل الفقهية التي حواها مختصر خليل والمتخرجة على التغليب الفقهي. ويتناول البحث هذه المسائل الفقهية بالدراسة والتحليل, لإبراز أركان وشروط التغليب الفقهي ومقتضيات حصوله في هذه المسائل, مع بيان ما جاء من تفصيل ذلك في شروحات مختصر خليل المختلفة.
