| Abstract | ||
| يتناول هذا البحث أثر المستجدات التقنية والمعرفية الحديثة على مقصد المحافظة على العرض في مسائل الخطبة، من خلال دراسة فقهية معاصرة تُظهر مرونة الشريعة الإسلامية وقدرتها على مواكبة التغيرات الزمانية والمكانية. ويركّز البحث على دور الوسائل التقنية الحديثة مثل الإنترنت ووسائل الاتصال في تسهيل التعارف بين الراغبين في الزواج، مع التأكيد على ضرورة التقيد بالضوابط الشرعية لضمان تحقيق مقاصد الشريعة، خاصة فيما يتعلق بصون العرض وحماية القيم الإسلامية. كما يناقش البحث مشروعية الخطبة، ويبين أنها وعد غير ملزم بالزواج، مستعرضًا آراء الفقهاء في هذا الشأن، ومؤكدًا أهمية التجديد المنضبط في فقه الأحوال الشخصية بما يحقق المصلحة دون الإخلال بالنصوص الشرعية. This research examines the impact of modern technological and cognitive developments on the objective of preserving honor in engagement matters. It examines a contemporary jurisprudential study that demonstrates the flexibility of Islamic law and its ability to keep pace with temporal and spatial changes. The research focuses on the role of modern technological means, such as the internet and other means of communication, in facilitating acquaintance between those wishing to marry, while emphasizing the necessity of adhering to Sharia guidelines to ensure the achievement of Sharia objectives, particularly with regard to preserving honor and protecting Islamic values. The research also discusses the legitimacy of engagement, demonstrating that it is a non-binding promise to marry. It reviews the views of jurists on this matter, emphasizing the importance of disciplined renewal in personal status jurisprudence to achieve the public interest without compromising Sharia texts. | ||
