| Abstract | ||
| يتناول هذا البحث القضاء في محمية شرق أفريقيا البريطانية في الفترة من 1895م- 1920م، وهي دراسة وثائقية في ضوء التقارير السنوية للحاكم العسكري البريطاني والإدراة الاستعمارية، فالنظام القضائي في هذه المحمية مستوحى بشكل كبير من النظام القائم في الهند البريطانية، وجاء اهتمام بريطانيا بالنظام القضائي في المحمية ليعمل على تثبيت أقدامها وفرض سيطرتها، وهدف إلى التعرف على استغلال النظام الاستعماري البريطاني للقانون كأداة لتوطيد سلطته في محمية شرق أفريقيا البريطانية، والتغيرات التي أدخلتها سلطات الحماية البريطانية على الهيكل الإدراي والقضائي الإسلامي الموجود في الساحل الأفريقي، ودور بريطانيا في دخول القوانين الإنجليزية والهندية على السكان الأوروبيين داخل المحمية، إلى جانب القوانين واللوائح الإسلامية، التي كانت تخضع لسلطات الحماية البريطانية. Abstract: This research addresses the judiciary in the British East Africa Protectorate from 1895 to 1920, a documentary study considering the annual reports of the British military governor and the colonial administration. The judicial system in this protectorate is largely inspired by the system in British India Britain's interest in the judicial system in the protectorate aimed to solidify its presence and impose its control. It also sought to understand the exploitation of British colonial law to consolidate its authority in the British East Africa Protectorate, as well as the changes the British protectorate authorities made to the existing Islamic administrative and judicial structure along the African coast. Additionally, it addresses Britain's role in introducing English and Indian laws to the European population within the protectorate, alongside the Islamic laws and regulations that were subject to British protectorate authorities. | ||
