| Abstract | ||
| إن هذا البحث يدور حول الاستصحاب، وأهميته وتأثيره في المسائل، واختص البحث بالاعتناء بإبراز أثره عند الحنابلة، وهذا البحث لا يندرج ضمن البحوث الأصولية، بل بحث تطبيقي، يبحث مجموعة من المسائل التي بنيت على الاستصحاب، واستخراج الاستصحاب من كلام الفقهاء، وكيفية بناء الاستصحاب في مسائل البحث، واختلاف الفقهاء في الاستصحاب في مسائل البحث، فربما اتفقوا على الاستصحاب في المسألة، واختلفوا في الأصل المستصحَب، وربما اختلفوا بسبب اختلافهم تقديم الاستصحاب على غيره من الأدلة، وغير ذلك من الأسباب المتعلقة بالاستصحاب، كل هذا من خلال أسلوب التحليل في عنصر (علاقة الاستصحاب بالمسألة)، ومن مزايا البحث: بيان اشتراك الاستصحاب مع القياس في الاستدلال أحياناً، ورجوع بعض القواعد الفقهية التي استدل بها أهل العلم في مسائل البحث إلى الاستصحاب، فالبحث أبرز تأثير الاستصحاب في المسائل الفقهية، واعتناء الحنابلة به ورجوعهم إليه. وقسمت كل مسألة من مسائل البحث إلى خمسة عناصر: الأول: عبارة المغني في المسألة، والثاني: الشرح: وفيه توضيح وتصوير للمسألة، والثالث: الأقوال في المسألة، والرابع: الأدلة، والخامس: علاقة الاستصحاب بالمسألة، ثم ختمت البحث بأبرز ما توصلت إليه من النتائج، وقائمة المراجع. This research revolves around istishab, its importance and its impact on issues. The research focused on highlighting its impact on the Hanbalis. This research does not fall within fundamentalist research, but rather an applied research that examines a group of issues that were built on istishab, extracting istishab from the words of jurists, and how to build istishab into research issues. The jurists differed regarding the isstihab in the issues of research. They may have agreed on the isstihab in the issue, and they differed on the principle that is recommended, and perhaps they differed because of their disagreement in prioritizing the isstihab over other evidence, and other reasons related to the isstihab, all of this through the method of analysis in the element (the relationship of the isstihab to the issue). Among the advantages of the research: an explanation of the participation of istishab with analogy in reasoning at times, and the return of some of the jurisprudential rules that scholars used as evidence in the research issues to istishab. The research highlighted the effect of istishab in jurisprudential issues, and the interest of the Hanbalis in it and their return to it. Each research issue was divided into five elements: the first: Al،Mughni’s statement on the issue, the second: explanation: which contains clarification and illustration of the issue, the third: statements on the issue, the fourth: evidence, and the fifth: the relationship of accompaniment to the issue. Then I concluded the research with the most prominent results I reached and a list of references. | ||
