| Abstract | ||
| أن معالم مقدمات الكتب القضائية تتلخص في المعالم التالية: براعة الاستهلال في مطلع المقدمة. الحديث عن فضل الفقه عموما، وعلم القضاء خصوصا. وذكر دواعي وأسباب التأليف، وهذا أكثر المعالم وروداً في المقدمات. وذكر منهج المؤلف في تأليف الكتاب. وذكر ترتيب أبواب الكتاب في المقدمة. وذكر موارد المؤلف في كتابه. ومدح بعض المؤلفين لكتابه، أو للكتاب الذي يشرحه. والتصريح باسم المؤلف في المقدمة. والتصريح باسم الكتاب الذي يختاره. وذكر تاريخ تأليف الكتاب. وختم المقدمة بالدعاء. وقد تضمنت بعض المقدمات فوائد متنوعة كبعض النصائح للقضاة، والوعظ والإرشاد لهم، وربما أهدى بعضهم كتابه لبعض السلاطين في عصره. وخلت بعض الكتب القضائية من مقدمة يتعرف منها على الكتاب، وذلك ككتاب أدب القاضي لأبي بكر الخصاف (ت261هـ)، وكذلك شرحه لأبي بكر الجصاص (ت370هـ)، وأدب القاضي والقضاء لأبي المهلب هيثم بن سليمان القيسي (ت275هـ)، وبعض الكتب فيها مقدمة مختصرة ليس فيها شيء من المعالم كمقدمة كتاب أدب القضاء لأحمد بن إبراهيم السروجي (ت710هـ). The features of introductions to judicial books can be summarized in the following: A brilliant introduction at the beginning of the introduction. Discussing the merits of jurisprudence in general, and judicial science in particular. The motivations and reasons for writing the book are mentioned, and this is the most common feature in introductions. The author's method in writing the book is mentioned. The order of the book's chapters is mentioned in the introduction. The author's resources are mentioned in his book. Some authors praise their books, or the books they explain. The author's name is stated in the introduction. The name of the book he chooses is stated. The date of writing the book is mentioned. The introduction is concluded with a supplication. Some introductions included various benefits, such as advice for judges, preaching, and guidance. Some of them may have dedicated their books to certain sultans of their time. Some judicial books lacked an introduction from which one could learn about the book, such as the book "Adab al،Qadi" by Abu Bakr al،Khasaf (d. 261 AH), as well as its commentary by Abu Bakr al،Jassas (d. 370 AH), and "Adab al،Qadi wa al،Qada" by Abu Al،Muhallab Haytham ibn Sulayman al،Qaysi (d. 275 AH). Some books contain a brief introduction that lacks any of the features of al،Ma'alim, such as the introduction to the book Adab al،Qada' by Ahmad ibn Ibrahim al،Saruji (d. 710 AH). | ||
