Abstract | ||||
ملخص يعد المنطق أداة مهمة في بناء الاستدلال القانوني، ومن هنا تأتي أهمية هذا البحث للأسباب الآتية: 1- يقوم المنطق بأنماطه الاستدلالية المتعددة في صياغة الاستدلالات القانونية التي يمارسها کل من المشرعين والقضاة والمحامين، وما إلى ذلک. 2- يتميز المنطق بآلياته الفنية في تحديد صحة الاستدلالات القانونية، وأيضا في تحليل النصوص القانونية والممارسة القانونية بوجه عام من خلال مراعاة السمات المنطقية کالاتساق والترابط. يبدأ البحث بمقدمة تناولت حدود البحث وأهميته والهدف منه والمنهج المستخدم. ثم عرضنا لطبيعة العلاقة بين المنطق والقانون، وما تضمنته من خلاف. مما أدي بنا لعرض الاستدلال القانوني باعتباره حلقة الوصل الرئيسية بين المنطق والقانون، وما تتطلبه من تفسير لماهيته من خلال أنه منطقيا في صورته قانونيا في محتواه، مما دفع بنا للتطرق إلى أوجه اعتماد الاستدلال القانوني على المنطق أو بوجه أدق توضيح الهدف الرئيسي للبحث وهو إبراز النماذج الاستدلالية للاستدلال القانوني سواء کانت استنباطية أو غير استنباطية. | ||||
