| Abstract | ||||
| إن مراحلَ خلقِ الجنين في بطن أمِّه، قد وردت صريحةً في کتاب الله تعالى، وکذلک في سنة النبيِّ (r) فنصوصها محکمةٌ لا تحتاج إلى تأويل، ولا يمکن أن يختلف عليها اثنان، لکنَّ الأمرَ غيرَ القطعيِّ، هو زمنُ هذه الأطوارِ، وکذلک زمنُ نفخ الروح، وقد روى البخاريُّ حديثا، عن عبد الله بنِ مسعود، فَهِمَ منه معظمُ العلماءِ أن ثمَّ ثلاثَ مراحلَ، تستغرق کلُّ واحدة منها، أربعين يومًا، فيکونُ الإجمالي مائةً وعشرين يومًا، ثم يُنفَخ فيه الروحُ بعد ذلک، ولکنَّ علماءَ الطب والتشريحِ، وعلماءَ الأجنة، تتواتر أقوالهم على أن خلق الجنينِ يکون قبل أربعةِ أشهر بکثير، ومن هنا ظهرت مشکلة البحث، ألا وهي هل ينفخ في الجنين الروح بعد مائة وعشرين يومًا، وهذا ما يتحفظ عليه کثير من الأطباء؛ بناء على نتائج بحوثهم، وهذه الإشکالية سوف يجيب عنها هذا البحث، بفضل الله تعالى. الهدف من البحث: يهدف هذا البحث إلى جمع النصوص الواردة في مسالة الأطوار، ونفخِ الروح في الجنين، وخلاصة البحوث الطبية في ذلک، وعمل مقارنة بينها، وذلک بعد دراسة النصوص الشرعية. المنهج المتبع: اعتمد الباحث على عدة مناهج، منها المنهجُ الوصفيُّ، والمنهجُ التاريخيُّ، والمنهجُ التحليليُّ، والمنهجُ المقارنُ. النتائج والتوصيات: توصل الباحث إلى کثير من النتائج والتوصيات، يمکن تلخيص بعضها فيما يلي: أهمية دراسة أطوار الجنين، ونفخِ الروح فيه، لترتب أحکام فقهية کبيرة عليها، وأن الحياة الإنسانية تبدأ بنفخ الروح في الجنين، حسب قول جماهير أهل العلم، وقد أجمع علماء الشريعة، وعلماءُ الطب على ترتيب الأطوار، من النطفة، ثم العلقةِ، ثم المضغة، وقد بنى الفقهاء فتاويَهم في الإجهاض وغيره من الأحکام الشرعية على تحديد وقت نفخِ الروح في الجنين، وتوصل الباحث إلى أن الأطوار الثلاثة، تکون کلُّها في الأربعينَ الأولى، وکذلک تتميز معظمُ الأعضاءِ في الفترة نفسٍها، ويکون بعدها نفخ الروح، ولا يمکن أن نقطع بموعده. وتوصي الدراسة في هذا البحث بضرورة الاحترام الکامل للجنين، من الأسبوع الأول، وعدمِ التعدي عليه، وضرورة مراجعة کلِّ الفتاوى التي تتساهل في التعامل مع الجنين، قبل مائة وعشرين يومًا؛ اعتمادًا على أنه لم يُنفخ فيه الروح، وأوصت الدراسة بضرورة الإفادة من العلوم الحديثة في خدمة العلوم الشرعية، فالإسلام کرم العلم وأهلَه، وضرورة إبراز الإعجاز العلمي لما جاء في الکتاب والسنة. The stages of a fetus’s creation in its mother’s womb have been explicitly mentioned in the Book of God Almighty, as well as in the Sunnah of the Prophet. Its texts are courteous and do not need interpretation, and no two can disagree over them, but the matter is not definitive, is the time of these phases, as well as the time of soul breathing Al-Bukhari narrated a hadeeth, on the authority of Abdullah bin Masoud, from which most scholars understood that there are three stages, each of which takes forty days, so the total is one hundred and twenty days, and then the soul is breathed into it after that, but medical and anatomists, and embryologists, frequent Their sayings that the creation of the fetus took place much earlier than four months, and from here the research problem appeared, namely, does the soul breath in the fetus after one hundred and twenty days, and this is what many doctors have reservations about. Based on the results of their research, this problem will be answered by this research, thanks to God Almighty. The aim of the research: This research aims to collect texts contained in the issue of the phases, and the breathing of the soul into the fetus, and a summary of medical research in that, and make a comparison between them, after studying the legal texts. Approached Approach: The researcher relied on several approaches, including the descriptive method, the historical method, the analytical method, and the comparative method. Results and recommendations: The researcher reached many results and recommendations, some of which can be summarized as follows: The importance of studying the phases of the fetus, and breathing the soul into it, in order to arrange great jurisprudence rulings on it, and that human life begins with the breath of the soul into the fetus, according to the saying of the majority of scholars. The jurists have based their fatwas on abortion and other legal rulings on determining the time for the soul to be breathed into the fetus, and the researcher has concluded that all three phases are in the first forty, and most of the organs are distinguished in the same period, after which the soul is breathed, and we cannot cut off its date. The study recommends in this research the necessity of full respect for the fetus, from the first week, not to encroach upon it, and the necessity of reviewing all Fatwas that tolerate dealing with the fetus, one hundred and twenty days before. Depending on the fact that the soul has not been breathed into it, and the study recommended the necessity of making use of modern sciences in the service of Sharia sciences, Islam is the generosity of knowledge and its people, and the need to highlight the scientific miracles of what is stated in the Qur’an and Sunnah. | ||||
