| Abstract | ||||
| يتناول هذا البحث دراسة لظاهرة هروب العبد من سيده أو کما عُرفت هذه الظاهرة في کتب النوازل باسم (الإباق)، وفيه يدرس الباحث أهم أسباب هروب العبد والدوافع التي تجعله يقرر الهروب، ثم دراسة لظاهرة الإباق نفسها في المجالين الاقتصادي والاجتماعي، أما في المجال الاقتصادي فقد مثلت ظاهرة الإباق أغلب القضايا والمسائل ذکرًا في کتب النوازل من حيث تأثير الإباق على عمليات بيع وشراء العبيد في بلاد الغرب الإسلامي، أما من المجال الاجتماعي فقد ارتبط الإباق بالعديد من القضايا الاجتماعية التي تخص أمور الزواج والطلاق والعتق والقضاء، وفي نهاية البحث تم دراسة العقوبات التي طُبقت على العبد الآبق بعد استعادته سواء کانت تلک العقوبات من السيد أو القاضي أو السلطان. this research deals with a study of the phenomenon of the slave's escape from his master, which is known in the books of Al nawazil under the name of (Al-Ibaq), and through this papers, the researcher studies the most important causes of the slave's escape and the motives that make him decide to escape, and then a study of the phenomenon in the economic and social fields. Al Ibaq in the economic field represented most of the issues mentioned in the books of Al nawazil, and the effects of Ibaq on the sale and purchase of slaves in the countries of the Islamic West. As for the social field, Al Ibaq was associated with many social issues related to matters of marriage, divorce, manumission of slaves, and the judiciary, and at the end of the research, the researcher shows the punishments that were applied on the fugitive (Al abeq) after his restoration, whether those punishments were from the master, the judge, or the Sultan. | ||||
