| حکم البيع قبل القبض دراسة فقهية مقارنة خالد يوسف الجهيّم القسم، فقه مقارنه، الکلية: الشريعة والدراسات الإسلامية، الجامعة، الکويت، المدينة الدولة الکويت. البريد الإلکتروني: aboabdallah078@gmail. com الملخص: الهدف من البحث: الوقوف على مفهوم البيع في اللغة والاصطلاح، استخراج الأحکام الفقهية التي تتعلق بالبيع قبل القبض من أقوال الفقهاء. والمنهج المتبع، المنهج الاستقرائي؛ حيث أقوم باستقراء أقوال الفقهاء في مسألة البيع قبل القبض، وبيان طريقتهم في تناولها من خلال استقراء کلامهم فيها، والمنهجين الاستدلالي والتحليلي النقدي؛ حيث أقوم بذکر أقوال الفقهاء في المسائل الفقهية، مع ذکر أدلة کل قول، ومناقشتها مناقشة علمية، وصولا إلى الراجح من الأقوال في المسألة. The Provision of Selling Objects before receiving their Prices A Comparative Jurisprudential Study By: Khaled Youssef Al-Juhaim Department of Comparative Jurisprudence Faculty of Sharia and Islamic Studies University of Kuwait The State of Kuwait Abstract The research at hand intends to clarify the concept of selling objects in language and convention as well as drawing the jurisprudential provisions related to selling objects before receiving their prices; from the sayings of the jurists. The research follows the inductive approach where the researcher extrapolates the sayings of the jurists concerning the issue of selling objects before receiving their prices and highlighting their methodologies of handling the issues through examining their words and texts. The approaches of deduction and critical analysis are also utilized by the researcher as he refers to the sayings of the jurists regarding the jurisprudential issues supported by clues connected to each saying and the researcher discusses them scientifically till the preponderant saying related to the issue is settled. The research concludes with the findings and recommendations. | ||||
