Abstract | ||||
Before Islam, women did not have the right to be human, having been stripped of their humanity throughout history and considered by civilizations preceding Islam, such as Greek civilizations and Roman, Greek, Hindi, Chinese, and Arabic, some sort of demons and they likened it to animals, trees, poisoned plants or Harmful as snakes. Women have not only flouted old civilizations, but other religions have met with them in this view, such as Jews and Christians as a sort of demon, they took responsibility for the exodus of Adam from Paradise, and it was the cause of the man's misery on Earth. They stripped her of all her human rights and considered her at home without a man. It does not own or inherit, but owns and inherits the man, whether her father, brother or son. It was therefore not recognized as an independent financial asset.But Islam came to free women from all of this, and it recognizes their humanity, both as men. They are recognized as having legal personality, both positive and negative (eligibility and capacity to perform). and financial assets independent of her husband. The right to acquire entry in any area of legitimate acquisition, whether by inheritance, wills, donation, employment or investment. That human progress from Islam to women has only recently been recognized by the international community with the promulgation of the Universal Declaration of Human Rights in 1948 and the promulgation of the International Covenants on Human Rights in 1966. All this became effective only with 53 states signing the Covenants in 1976 and increasing the signatories to 140 States at the close of the twentieth century in 1998. In this research, we will try to indicate a single type of financial rights that Islam has recognized for women and where they are equated with men. It is their right to gain access to both their work and their various investments, by recognizing them as legal persons and financial assets independent of men. With an applied study, it illustrates the reality of the application of the first and the modern Islamic societies. But the logical order of the subject requires that we be given a statement of doctrinal basis. | ||||
