| من الظواهر الإجرامية المستحدثة نقل عدوي فيروس کورونا المستجد، فقد أصبحت وسائل ارتکاب الجريمة حاليًا غير قاصرة علي الحجر أو الحديدة أو حتي البارود، فقد تطورت لتکون من سوائل الجسم أو الأنفاس المحملة بالفيروس، ويکون من يحمل الفيروس في جسمه أخطر علي المجتمع ممن يحمل بندقية أو قنبلة ؛ لأنه قد يتسبب في نقل المرض إلي الآلاف من الناس سواء عن عمد أو عن طريق الإهمال. ويثير فعل نقل عدوى فيروس کورونا المستجد کثيرا من المشکلات بسبب عدم وجود نص خاص به، وما يتفرع عن ذلک من صدام مع مبدأ شرعية الجرائم والعقوبات، حيث لم يتم تجريم نقله بنص خاص وصريح بالرغم من خطورة هذا الفعل، ولا شک أن هذا الأمر أدى إلي إشکالية کبيرة تتمثل في صعوبة توقيع العقاب علي مرتکب هذا الفعل إلي غيره عمدًا أو عن طريق الخطأ. وإذا کانت المسئولية الجنائية لا تنشأ إلا في حالات حددها القانون على سبيل الحصر، وهي أن يقارف الجاني فعلًا يحظره القانون، أو امتناعًا يوجب القانون القيام به، فقد تناولت هذه الدراسة الحلول لهذه الإشکالية عن طريق إعادة قراءة النصوص القائمة، مع الدعوة المستمرة للمشرع الجنائي لوضع النص الخاص الذي يجرم نقل عدوي کورونا المستجد. Abstract: One of the new criminal phenomena is the transmission of the new Corona virus infection. The act of transmitting the emerging corona virus infection raises many problems due to the absence of a special text for it, and the clash with the principle of legality of crimes and penalties, as it was not criminalized by a special and explicit text despite the seriousness of this act, and there is no doubt that this matter led to A major problem is the difficulty of imposing punishment on the perpetrator of this act to others, intentionally or by mistake. And if criminal responsibility does not arise except in cases specified by law exclusively, which is that the offender commits an act prohibited by law, or an abstention that the law requires to be done, then this study addressed solutions to this problem by re-reading the existing texts, with the continuous call for the criminal legislator to put The special text that criminalizes the transmission of the emerging corona infection. | ||||
