| Abstract | ||||
| الطابع الاتفاقى للتحکيم، رغم ما يحققه للدعوى التحکيمية من سرعة للفصل في النزاع وبساطة في الإجراءات، إلا أنه لا يخلو من مثالب عديدة تعزى إما إلى عدم خبرة الأطراف بالعملية التحکيمية فلا يجيدون صياغة اتفاق التحکيم، أو إلى عدم خبرة المُحکمين أنفسهم أو حرصهم على الحصول على أتعاب التحکيم، التى قد تکون في بعض القضايا مبالغ کبيرة، غير عابثين أو مکترثين أو مهتمين بسلامة وصحة إجراءات التحکيم، فضلاً عما قد يشوب أسلوب وطريقة إدارة الدعوى التحکيمية من جانب مرکز التحکيم المتفق على اختصاصه من مخالفات وتجاوزات. کل ذلک قد يؤدى إلى إشکاليات قانونية تعرقل سير الدعوى التحکيمية وإصدار حکم فيها، وقد تعرضه للبطلان، وتلک الصعوبات وما ينتج عنها من مسائل قانونية تدفع أطراف التحکيم إلى اللجوء لقضاء الدولة لحسمها والبت فيها. وهذا مؤداه إفراغ ميزة التحکيم المتمثلة في سرعة الفصل في النزاع وبساطة الإجراءات من مضمونها، حيث غالباً ما يستغرق نظر القضاء لتلک المسائل القانونية وقتاً طويلاً، الأمر الذى قد يعصف بمنظومة التحکيم ويهدرها من أساسها، وذلک لانهيار أحد أعمدته الرئيسية وهو البعد عن التقاضى أمام قضاء الدولة وتجنب تعقيدات إجراءاته وطول أمد الفصل في النزاعات. فقد تلاحظ في الآونة الأخيرة أن الفصل في بعض القضايا التحکيمية يستغرق وقتاً طويلاً قد يفوق الوقت الذى تستغرقه الدعوى القضائية. Abstract: This consensual nature of arbitration, despite what it achieves for the arbitration case in terms of speed of settlement of the dispute and simplicity of procedures, is not without many shortcomings attributed either to the parties’ inexperience in the arbitral process and not proficient in drafting the arbitration agreement, or to the inexperience of the arbitrators themselves or their eagerness to obtain The arbitration fees, which in some cases may be large sums, are not tampering with, indifferent or concerned with the safety and correctness of the arbitration procedures, in addition to the violations and abuses that may mar the style and method of managing the arbitration case on the part of the arbitration center agreed on its jurisdiction. All of this may lead to legal problems that hinder the progress of the arbitration case and issue a judgment in it, and may expose it to invalidity, and these difficulties and the resulting legal issues push the arbitration parties to resort to the state’s judiciary to resolve and decide on them. This leads to emptying the advantage of arbitration represented in the speed of settling the dispute and the simplicity of the procedures from their content, as it often takes a long time for the judiciary to consider these legal issues, which may ravage the arbitration system and waste it from its foundation, due to the collapse of one of its main pillars, which is the distance from litigation before the state judiciary And avoid the complexities of its procedures and the length of time to resolve disputes. You may have noticed recently that the resolution of some arbitration cases takes a long time, which may exceed the time taken by the lawsuit. | ||||
