Abstract
ألزم المنظم السعودي التاجر بمسك الدفاتر التجارية سواءً كان شخص طبيعي أو اعتباري، وذلك لما تؤديه هذه الدفاتر من فائدة جليلة سواء للتاجر ذاته أو للمتعاملين معه أو للدولة ذات نفسها.
فلا شك أن الدفاتر التجارية المنتظمة تعد بمثابة مرآة التاجر، يستطيع من خلالها معرفة مدى نجاحه في مباشرة عمله التجاري، وتحديد مركزه المالي بدقة.
وبعد التطور التكنولوجي الحديث، واتساع مجالات النشاط التجاري، وظهور الحاسب الآلي وما يحققه من سرعة في قيد وتسجيل العمليات المالية وتبويبها والترحيل وإعداد الحسابات الختامية، إضافة إلى تخفيض تكاليف العمل المحاسبي وتحقيق رقابة وضبط داخلي أفضل من الأعمال المحاسبية، ظهرت الحاجة إلى استخدام الحاسب الآلي في مجال تدوين البيانات الخاصة بالدفاتر التجارية، وقد كانت المملكة سباقة في تقنين إدخال الحاسب الآلي في هذا المجال ونصت على ذلك صراحة في نظام الدفاتر التجارية، ومشروع نظام المعاملات التجارية المقدم من وزارة التجارة.
وبما أن الحياة التجارية لا تخلو من حصول خلافات بين التجار بعضهم البعض أو مع غيرهم ممن لا يحترفون التجارة. ومن هنا، يأتي دور الدفاتر التجارية وخاصة الالكترونية كحجة في إثبات الحقوق الناشئة عن هذه المعاملات، سواء كانت لمصلحة التاجر أو ضد مصلحته. ويأتي هذا البحث ليسلط الضوء على حجية الدفاتر التجارية الالكترونية في الإثبات من خلال تحليل النصوص الواردة في نظام الدفاتر التجارية السعودي ولائحته التنفيذية، وما صدر من أنظمة حديثة مكملة، مثل نظام المحاكم التجارية ونظام الإثبات.

Abstract:
The Saudi regulator obligated the merchant to keep commercial books, whether he was a natural or legal person, due to the great benefit that these books provide, whether for the merchant himself, his dealers, or the country itself.
There is no doubt that the regular commercial books are the mirror of the merchant, through which he can know the extent of his success in conducting his business, and determine his financial position, accurately.
After the modern technological development, the expansion of the fields of commercial activity, the emergence of the computer and the speed it achieves in the registration and recording of financial operations and their classification, deportation and preparation of final accounts, in addition to reducing the costs of accounting work, and achieving better internal control and control than accounting work, the need to use the computer appeared in The field of recording data related to commercial books.
The Kingdom was a pioneer in legalizing the introduction of computers in this field, and this was explicitly stipulated in the commercial book system, and the commercial transaction system project submitted by the Ministry of Commerce.
Moreover, since the commercial life is not free from the occurrence of disputes between the merchants, each other, or with others who are not professional in trade. Hence, the role of commercial books, especially electronic ones, as an argument in establishing the rights arising from these transactions, whether they are for the benefit of the merchant or against his interest. This research comes to shed light on the authenticity of electronic commercial books in evidence by analyzing the texts contained in the Saudi commercial book system and its executive regulations, and the issued complementary modern systems, such as the commercial courts system and the evidence system.
