| Abstract | ||||
| إن النزعة الإنسانية هي الدافع الأول لاعتماد العقوبات الذكية كتدبير عقابي يرتجي منه الحد أو عقد العقوبات و الناجمة عن اعتماد على الأقل التقليل من الكلفة الإنسانية الباهظة المسجلة خلال العقوبات الاقتصادية الشاملة التي تقوم على العشوائية في العقاب، والتي لا تميز بين الجناة والمارة الأبرياء، بحيث أنها أضرت بحقوق الإنسان دون أن تحدث التغيير المنشود بالضغط على الحكام. والعقوبات الذكية البديل للعقوبات الاقتصادية التقليدية أريد لها أن تقوم على الانتقائية والاستهداف، والتي مارستها كل من منظمة الأمم المتحدة والاتحاد الأوروبي والولايات المتحدة منذ منتصف ذلك، بحيث لا التسعينيات من القرن الماضي وقال منظروها بإنسانيتها، نجد أن الواقع يؤكد خلاف هنالك حلقات للعقوبات تستمر فيها الانتهاكات لحقوق الإنسان ما يعطي الانطباع أن التغير تزال المنشود كان في الألفاظ دون أن يمس الإجراءات و الممارسات، وبالتالي الهدف. وما بقاء اغتصاب لحقوق الإنسان ما دليل على استمرار العقوبات الشاملة ؟.
