Abstract | ||||
مطالبة النافي بالدليل من المسائل المختلف فيها بين الأصوليين، وقد وضعوا لها عناوين مختلفة مما أوقع في لبس وخلط بينها وبين مسائل أخرى كمسألة (الاستدلال بالعدم) ومسألة (استصحاب العدم الأصلي) فأردت الوقوف على حقيقة المسألة والأقوال الواردة فيها مرجحة ما رأيت أنه الصواب ومبينة العلاقة بينها وبين مثيلاتها. وقد اتبعت في هذا البحث المنهج الاستقرائي ثم التحليلي ثم الاستنباطي، فقد تتبعت أقوال العلماء في المسألة وذكرت أدلة كل فريق على ما ذهب إليه محررة محل النزاع ومقارنة بين أقوالهم حتى أصل لتأصيل هذه المسألة ، محاولة الالتزام بضوابط البحث العلمي وأسسه قدر الإمكان. وقد توصلت في نهاية البحث لعدد من النتائج، منها: أن حاصل الأقوال الواردة في المسألة يرجع إلى ثلاثة فقط ، الأول كون النافي مطالبا بالدليل في المسائل النظرية شريطة كونه يدعي العلم بالنفي لا نفي العلم ، والثاني عدم مطالبته بالدليل ، والثالث مطالبته بالدليل في نفي العقليات دون الشرعيات. وأن مدارك نفي الحكم الشرعي إما إجماع على النفي أو نص به أو قياس مع كون الجامع وجود مانع أو عدم شرط ، وأن مسألة الاستدلال بالعدم أخص من مسألة مطالبة النافي بالدليل ؛ إذ الاستدلال بالعدم أحد الأدلة التي قد يستدل بها على نفي الحكم ، وأنه لا يوجد اختلاف بين الاستصحاب والاستدلال بالعدم من حيث مؤدى كل منهما وإنما الاختلاف فقط في كيفية الاستدلال أو نهج المستدل ، وأن الاستدلال بالعدم حجة للنافي في حق الله تعالى وله أن يفتي به غيره ، ولا يكون حجة لأحد الخصمين على الآخر إذا لم يكن مما تتوفر الدواعي على نقله. Al-Nafi's claim to the evidence is one of the different issues among the fundamentalists, and they placed different titles for it, which confused it with other issues such as the issue (inference of nothingness) and the issue (elemental withdrawal). I wanted to know the truth of the issue and the statements contained therein, weighing what I thought was right and indicating the relationship between them and their peers. In this research, I followed the approach of induction, then analysis, then deduction. I followed the statements of scientists in the matter, and I mentioned the evidence of each team on what the editor at issue had said, and compared their statements until I reached the origin of this issue, an attempt to adhere to the rules of scientific research and its foundations as much as possible. At the end of the research, I came to a number of conclusions, including: The sum of the statements in the matter is due to only three; the first is that the denier is required to give evidence in theoretical matters, provided that he claims science to negate science, the second is not required to do so, and the third is his claim to proof in denying illegality. that the perception of the negation of the Shariah clause is either unanimous, stated or measured, with the Mosque having an objection or unconditional, and that the question of the inference of nullity is more important than the issue of the claim of the denier for evidence ; Inference by nullity is one of the evidences of a ruling's negation, and there is no difference between approval and inference by nullity in terms of their respective meaning, only difference in how the inference is based or the approach of the inference, and that inference by nullity is an argument against the truth of God Almighty and may be pronounced by others. | ||||
