Abstract | ||||
يعد التحكيم شكلا من أشكال تسوية المنازعات خارج المحاكم القضائية، حيث إنه في بعض الأحيان يلجأ الخصمان لشخص آخر غير القاضي ليفصل بينهما في الخصومة؛ وذلك إما لبعدهما عن مكان التقاضي، أو اختصارا لإجراءات التقاضي، أو لأي غرض آخر. ويعتبر الرضا، والقبول من الطرفين على تحكيم المحكم من أهم شروط التحكيم، لأن اختيارهما له كان بناء على الثقة الشخصية، ولكن ما الحكم إذا ما انهارت هذه الثقة التي كانوا يأملونها في المحكم، فهل يصبح من حقهم عزل المحكم أم لا؟ وإذا كان التشريع قد أعطى المتخاصمين الحق في الرجوع عن تحكيمه فهل هذا الحق على إطلاقه، أم أن له ضوابط وشروطا معينة؟ وقد خلص البحث إلى مجموعة من النتائج من أهمها: أن الرضا هو الرغبة في الفعل، والارتياح إليه، ولا يوجد تلازم بين الإرادة والرضا، فقد يريد المرء شيئا مع أنه لا يرضاه , وأن التحكيم شعبة من القضاء إلا أنه أقل رتبة من القضاء؛ وأنه يجوز للخصوم عزل المحكم قبل ان يصدر حكمه، ولا يشترط في العزل كيفية معينة، ولا شكلا معينا، فقد يكون صريحا، وقد يكون ضمنيا, كما يجوز للمحكم أن يعزل نفسه ويتنحى عن التحكيم في أي وقت شاء شريطة أن يكون ذلك قبل إصداره الحكم, ولا يشترط في عزل المحكم نفسه شكلا معينا أيضا، فقد يكون صريحا، وقد يكون ضمنيا, وإذا توفر السبب المشروع لرجوع المحكم، وكان رجوعه قبل إصداره حكمه، فإن هذا الرجوع يكون صحيحا دون توقف على قبول من الخصوم، وليس للمحكَّم تفويض التحكيم إلى غيره إذا صدر العقد مطلقا من المحكمين، Arbitration is a form of dispute settlement outside the courts, as sometimes the litigants resort to someone other than the judge to settle disputes; Either to remove them from the litigation, to shorten the proceedings, or for any other purpose. The consent and consent of the parties to the arbitration of the arbitrator is considered one of the most important conditions for the arbitration, because their choice of the arbitrator was based on personal confidence, but if the trust they had hoped for in the arbitrator breaks down, will they have the right to dismiss the arbitrator or not? If the legislation gave the disputants the right to revoke its arbitration, was that right to launch it, or did it have certain checks and conditions? The research yielded a number of findings, the most important of which are: satisfaction is the desire to act, satisfaction to act, and there is no correlation between will and consent, one may want something even though one does not consent to it, and arbitration is a division of the judiciary but subordinate to the judiciary; The parties may dismiss the arbitrator before he or she has delivered his or her judgment, and the dismissal does not require a particular method, form, form or form. It may be express, and may be implicit. The arbitrator may also self-disqualify and disqualify himself from arbitration at any time, provided that this is before the judgment is rendered. Dismissal of the arbitrator itself is not required by a particular form either. It may be express, and it may be implied.
