Abstract | ||||
إن كان الأصل هو عدم جواز إنهاء العقد بإرادة أحد طرفيه، ذلك أن العقد لا يجوز نقضه ولا تعديله إلا باتفاق الطرفين، إعمالاً للقاعدة المستقرة في القوانين أن العقد شريعة المتعاقدين؛ إلا أن اللوائح المنظمة لاحتراف كرة القدم أجازت لطرفي العقد أن ينهيه أحدهما من طرف واحد، متى استند في ذلك إلى مبرر مشروع. ومن بين الحالات التي يجوز فيها للاعب المحترف إنهاء العقد بإرادته المنفردة، عدم المشاركة في المباريات الرسمية، إضافة إلى امتناع النادي عن دفع الأجر للاعبه المحترف، فضلاً عن هبوط النادي إلى درجة أدنى من تلك التي كان عليها عند إبرام العقد، أو في حالة إخلال النادي بأي من الالتزامات الجوهرية الناشئة عن عقد الاحتراف. كما سمحت اللوائح المنظمة للاحتراف في مجال كرة القدم، للنادي الرياضي أيضاً، إنهاء عقد لاعبه المحترف من طرف واحد، ومن بينها، حالة توافر سبب مشروع لإنهاء العقد، إضافة إلى صدور قرار نهائي بإيقاف اللاعب لتعاطيه المنشطات، فضلاً عن صدور قرار من اتحاد كرة القدم بمنع اللاعب من مزاولة نشاطه الكروي. ولا شك أن في إنهاء عقد الاحتراف بالإرادة المنفردة، بالغ الأثر على كل من الأندية الرياضية واللاعب المحترف على حدٍ سواء؛ لذلك وضعت اللوائح المنظمة للاحتراف في مجال رياضة كرة القدم، جملة من الحقوق لحماية اللاعب أو النادي المحترف، كما أثقلت كليهما بجملة من الالتزامات نتيجة الإنهاء من جانبه دون سبب مشروع. If the principal is that a contract cannot be terminated by the will of one of the parties, the contract may be terminated or amended only by the agreement of the parties, pursuant to the rule of law that the contract is the law of the contractors; However, under the rules governing professional football, the parties to the contract may terminate the contract unilaterally, on the basis of a legitimate justification. In some cases, a professional player may terminate a contract of his own free will, such as not participating in official matches, not being paid to a professional player, not being paid by the club, and falling below the level of the club when the contract was concluded, or in the event of a breach by the club of any of the essential obligations arising from the professional contract. The regulations governing professional football also allow the sports club to unilaterally terminate a professional player's contract, including if there is a legitimate reason for terminating the contract, in addition to a final decision to suspend the player for doping, as well as a decision by the Football Association to ban the player from playing football. There is no doubt that the termination of the contract of professional will has a great impact on both sports clubs and professional players; The regulations governing professional football, therefore, established a number of rights to protect a professional player or club, and both were burdened with a number of obligations as a result of termination for no legitimate reason. | ||||
