Abstract | ||||
تطرق البحث إلى بيان دور الدولة الوقائي والعلاجي في توقي ومحاربة تفشى ظاهرة الفساد الوظيفي في مؤسسات الدولة. وقد تبع الباحث في بحثه المنهجِ الاستنباطي، وذلك بجمعِ النصوصِ والكتاباتِ المتعلقةِ بموضوعِ البحثِ في كتبِ فقهاءِ القانونِ ، ثم قُمْتُ بإعادة ترتيبِها وصياغتِها وِفْقَ ما يتماشى مع ترتيبِ البحثِ. وكان من نتائج البحث التأكيد على أنَّ للدولة دورًا وقائيًّا هامًّا يتمثل في صنع نظام إداري كفء وفعال يوجد به نظام رقابي جيد وشفافية واضحة في التعاملات, فوجود نظام مالي وإداري قوى وتنفيذه بشكل سليم هو الفيصل بين النجاح والفشل, والذي يعتمد على عدة عناصر أهمها: الهيكل التنظيمي المناسب, وذلك عن طريق تنمية الموارد البشرية, وإدارة ومتابعة الأداء دوريًّا, وتطوير الأداء وتحسينه, وأخيرًا التشجيع على الابتكار وأنْ يُنْسَبَ كلُّ عملٍ لصاحبِهِ, بالإضافة إلى نظام أخلاقي قوى, بالإضافة إلى الدور العلاجي المتمثل في المساءلة والمحاسبة, فمفهوم المساءلة يرتبط بعملية الإصلاح الإداري, حيث تعمل المساءلة عند تطبيقها بالشكل المناسب على تخليص المؤسسة من مظاهر الفساد الوظيفي وتدفعها نحو الاستقامة. وكان من نتائج البحث: التأكيد على ضرورة وضع برنامج عملي مدروس يقوم بالأساس على رفع الوعي الديني والقانوني والأخلاقي للموظف العام من خلال تبصيره بالآثار السيئة والمخاطر المترتبة على استغلال الموظف لوظيفته أو نفوذه الوظيفي وما يصاحب ذلك من انعكاسات سلبية . The research touched on the statement of the preventive and curative role of the state in preventing and combating the spread of the phenomenon of job corruption in state institutions. In his research, the researcher followed the deductive method by collecting the texts and writings on the subject of the research in the books of jurists. I then rearranged and drafted them in accordance with the research arrangement. One of the results of the research was the affirmation that the State has an important preventive role in creating an efficient and effective administrative system with a good regulatory system and clear transparency in dealings. A strong financial and administrative system and its proper implementation is the separation between success and failure, which depends on several elements, the most important of which are: The appropriate organizational structure, through human resources development, periodic performance management and follow-up, performance development and improvement, and finally, the promotion of innovation and attribution of every work, in addition to a strong ethical system, as well as the remedial role of accountability. The concept of accountability is linked to the management reform process, where accountability, when properly applied, helps rid the institution of corruption and pushes it towards integrity. The results of the research included: To emphasize the need to develop a practical and well-thought-out program based on raising the religious, legal and moral awareness of public officials through their perception of the adverse effects and risks of the employee's exploitation of his or her position or employment influence and the attendant negative repercussions. | ||||
