| Abstract | ||||
| تناولت الدراسة القابلية للتحكيم في نظام التحكيم السعودي الصادر بالمرسوم الملكي رقم 34/م المؤرخ 24/5/1433، الموافق 16 أبريل 2012، واتفاقية نيويورك المتعلقة بالاعتراف بتنفيذ أحكام التحكيم الأجنبية لعام 1958م، وذلك من خلال دراسة مفهوم التحكيم وأنواعه ومزاياه ومشروعيته، ومفهوم القابلية للتحكيم وشروطها، ومدى القابلية الشخصية والموضوعية للتحكيم، وقد اعتمدت هذه الدراسة على المنهج التحليلي والمنهج المقارن بين نظام التحكيم السعودي واتفاقية نيويورك لعام 1958م، كما اعتمدت الدراسة على العديد من الكتب والدوريات ذات الصِّلة بفقه التحكيم التجاري الدولي، وقد خرجت الدراسة بعدد من النتائج والتوصيات من أهمها؛ وجود أوجه تشابه كبيرة بين نصوص نظام التحكيم السعودي ونصوص الاتفاقية بخصوص الأحكام المتعلقة بالقابلية للتحكيم كما اتضح وجود اختلافات في بعض المسائل أوضحناها في الخاتمة، تعديل المادة الثانية من نظام التحكيم السعودي، والنص صراحة على عدم جواز تسوية المسائل المتعلقة بالنظام العام عن طريق التحكيم، نقترح على واضعي اتفاقية نيويورك تحديد قواعد اسناد موضوعية محددة تلتزم بها جميع الدول الموقعة على الاتفاقية. The present study deals with arbitrability in the Saudi arbitration system issued by Royal Decree No. 34/M dated 24/5/1433 (April 16, 2012) and the 1958 New York Convention relating to the recognition and enforcement of foreign arbitral awards. The study deals with the concept of arbitration, its types, advantages and legitimacy, the concept of arbitrability and its conditions, and the extent of personal and objective susceptibility to arbitration. This study has employed an analytical comparative approach and consulted many books and periodicals related to the jurisprudence of international commercial arbitration. The study has come out with a number of results and recommendations, the most important of which are: the significant similarities between the provisions of the Saudi arbitration system and the provisions of the Convention regarding provisions related to arbitration; the differences regarding some issues explained in the conclusion; amending Article Two of the Saudi Arbitration Law, and explicitly stipulating that issues related to public order may not be settled through arbitration. The study recommends that the New York Convention define specific substantive attribution rules by which all signatory countries should be bound. | ||||
