| Abstract | ||||
| حماية الإرادة الإنسانية واستنقاذها من موجبات الهلكة في السُّنة النبوية " دراسة منبثقة من حماية الإسلام للإرادة الإنسانية وربطها بالعقل الذي هو أساس التكليف، فقد خلق الله تعالى الإنسان وميزه عن سائر المخلوقات: بأنه المخلوق المكلف، أي المسؤول، وأن أي انتهاك لحرية الاختيار اعتداء على إنسانية الإنسان وإهدار لآدميته، وتكريم الله تعالى له بأن جعله يمتلك العقل الذي يجعله أهلاً للاختيار، فهو مختار كذلك، وهذه أسمى معاني الإنسانية، وقد حرصتُ في دراستي هذه على محاولة الربط بين الاحكام الشرعية المستخرجة من الأحاديث النبوية المعنية بالمسؤولية الجنائية المنتفية بسبب الجنون أو العته وسائر الأمراض العقلية ،وتوظيف المسائل الفقهية بما يخدم حماية الإرادة الإنسانية واستنقاذها من موجبات الهلكة في ضوء منهج الهدي النبوي، وما يستنبط منه من أحكام فقهية أو أصولية، ومن أظهر الوجوه الفقهية المستنبطة من هذا البحث: حماية الإرادة الإنسانية من عصابات الاتجار في الإنسانية، واستغلال ظروف الضعف التي يمر بها الإنسان بسبب الكوارث أو الأزمات أن ينال من عرضه أو كرامته، وإلا استحق فاعله أن يكون الله ورسوله خصمين له في الدنيا والآخرة. The present study is based on Islam’s protection of the human will and linking it to the mind, which is the basis of obligation. Allah Almighty created man, singled him out as the only creature to assume responsibilities and honored him by granting him the mind that makes him eligible for making decisions, and this is the highest trait that humans have. In this study, I have focused on the legal rulings extracted from the Prophetic hadiths concerned with the criminal responsibility that is excluded due to insanity, dementia and other mental illnesses. I have employed jurisprudential issues to preserve the human will and spare it the causes of doom in the light of Prophetic guidance. Such issues have been used to derive jurisprudential rulings and fundamental jurisprudential principles. The jurisprudential examples include protecting the human will from human trafficking gangs, and exploiting the conditions of vulnerability that a person goes through due to disasters or crises. | ||||
