| Abstract | ||||
| اشتمل البحث على مقدمة وتمهيد ومبحثين وخاتمة تضمنت أهم النتائج والتوصيات، والفهارس ، وتكلمت فيه بنبذة مختصرة عن مشروعية الزواج، وأركانه، وشروطه، والحقوق الزوجية، والشروط فى النكاح وأقسام هذه الشروط، ثم تناولت تعريف ( البارت تايم) وأنها كلمة انجليزية معناها جزء الوقت، أو بعضه، والمقصود بهذا الزواج، ونشأته، وأنواع الزواج المشابهة له، والفرق بينها وبينه وأحكامهم، ثم تكلمت عن حق الزوجة فى المبيت وشرط إسقاطها لهذا الحق، وقدر المبيت عند الزوجة، واستحقاق الزوجة للقسم فى المبيت عند التعدد، ثم تناولت حكم زواج( البارت تايم) فى الشريعة الإسلامية للفقهاء المعاصرين، بأسلوب واضح، مقارنا بين المذاهب الفقهية، بذكر الآراء، وذكر أدلة كل مذهب ومناقشتها والرد عليه، كما قمت بالترجيح بين أقوال الفقهاء، وفقا لقواعد الترجيح، مبينا أسباب الترجيح، وأخيرا قمت بذكر رأي دار الإفتاء المصرية فى حكم هذا الزواج الحديث. The research included an introduction, a preface, two chapters, and a conclusion that included the most important findings, recommendations, and indexes. In it, I spoke with a brief summary of the legality of marriage, its pillars, conditions, marital rights, conditions in marriage, and the sections of these conditions. Or some of it, what is meant by this marriage, its origin, types of marriage similar to it, and the difference between it and it and their rulings, then I talked about the wife’s right to stay overnight and the condition for dropping this right, and the amount of staying overnight with the wife, and the wife’s entitlement to the oath in the overnight stay when polygamous, and then dealt with the ruling on marriage (Al-Bart Time) in Islamic law for contemporary jurists, in a clear manner, comparing between the schools of jurisprudence, by mentioning the opinions, and mentioning the evidence of each doctrine and discussing and responding to it, as I weighted among the sayings of the jurists, according to the rules of weighting, indicating the reasons for weighting, and finally I mentioned the opinion of the Egyptian House of Ifta in The ruling on this modern marriage. | ||||
