| Abstract | ||||
| عالج البحث مشكلة تتعلق بالأقليات المسلمة في مسائل الأحوال الشخصية في النكاح، والفرقة، وذلك فيما يتعلق باشتراط الولي للمرأة عند نكاحها، واشتراط إسلام القاضي الذي يتولى التفريق بين الزوجين، بالاعتماد على المنهج الاستقرائي والتحليلي، وقد اتضح من خلال هذا البحث، أن ولي المرأة المسلمة التي تعيش في البلدان غير الإسلامية هو من تحققت فيه شروط الولاية، وانتفت عنه موانعها، أما عند انعدام ولي المرأة أو من تحققت فيه شروط الولاية فإن رئيس المركز الإسلامي يقوم مقام وليها في النكاح أو رجل من المسلمين عدلا وإن لم يكن فقيهًا تختاره المرأة؛ ليزوجها بإذنها، أو أن تزوج نفسها أخذًا برواية من قال أن لها أن تزوج نفسها في هذه الحالة. كما أنه تبين من خلال النظر والبحث أن الذي يجري الفرقة بين الزوجين في البلدان غير الإسلامية هو المركز الإسلامي، وأن للمرأة اللجوء إلى القضاء غير المسلم فيما إذا لم تتمكن بحال من الأحوال أن تفارق زوجها إلا من خلال ذلك. والله أعلم. The research dealt with a problem related to Muslim minorities in matters of personal status in marriage, and the division, with regard to the requirement of the guardian of the woman when marrying, and the requirement of Islam judge who takes over the separation between the spouses, relying on the inductive and analytical approach, has become clear through this research, that the guardian of Muslim women living in non-Islamic countries is the one who achieved the conditions of guardianship, and the absence of impediments, but when the absence of a woman's guardian or who achieved the conditions of guardianship, the head of the Islamic Center He shall take the place of her guardian in marriage or a Muslim man who is just, even if he is not a jurist chosen by the woman, to marry her with her permission, or to marry herself, according to the narration of those who said that she may marry herself in this case. It has also been found through research and research that the separator between spouses in non-Muslim countries is the Islamic centre, and that a woman has recourse to the non-Muslim judiciary if she is in no way able to leave her husband except through that.
