| Abstract | ||||
| إن الشريعة الإسلامية هي خاتمة الشرائع؛ لذا كانت خالدة وعامة في رعايتها لمصالح جميع البشر، ومن ثم فقد أودع الله فيها من المصادر والأحكام ما يجعلها قادرة على أن تفي بحاجات الناس في وقائعهم المستجدة على مر العصور والأزمان، مع اختلاف الأماكن والعادات وتطور وسائل الحياة؛ لذا كان من مصادر التشريع الإسلامي الاجتهاد، فهو الينبوع العذب الذي ينهل الناس منه الأحكام في الوقائع المستجدة خاصة وأن نصوص الشريعة متناهية لا تفي بأحكام تلك الوقائع، وقد علم الرسول - r- هذا المنهج لأصحابه؛ حتى يستطيعوا القيام بأعباء الرسالة من بعده، فهذا البحث يهدف إلي إبراز مكانة تجزؤ الاجتهاد، ومدي حاجة المجتمع إليه عند عدم القدرة على الاجتهاد المطلق، وبيان أن هناك بديلًا نلجأ إليه عند الحاجة من خلال الوقوف على بعض اجتهادات الصحابة في علم الفرائض فيما لم ينزل به فرض كتاب ولا سنة. The Islamic Law [Sharia] is the final of all laws; therefore, it was an eternal and general law in its care for the interests of all human beings, Hence, Allah - the Almighty - has consigned to it sources and rulings, which makes it a law capable of meeting the needs of people in their new merits throughout the ages and times, under the variation of places and customs, and the development of means of life. Thus, one of the sources of Islamic legislation was ijtihad, as it is the sweet spring from which people draw rulings on emerging facts, especially since the texts of Sharia are finite and do not meet the provisions of those facts. The Prophet - peace be upon him - taught this approach to his companions, so that they can carry out the burdens of the message after him. This study aims to highlight the status of fragmentation of ijtihad, and the extent to which society needs it when unable to absolute ijtihad, and to show that there is an alternative to resort to when needed by the apprehension some of the Companions’ interpretations in the Science of Inheritance in what was not revealed by the Holy Qur’an or a Sunnah. | ||||
