| Abstract | ||||
| يهدف هذا البحث إلى بيان أحكام التغرير وأثره في عقود المعاوضات ، خاصة مع تطور الحياة وتغير أنماطها، واختلاف سلوك الناس وأخلاقهم، وتنوع التجارات والمبادلات بين الناس، وهذا مما أدى إلى تعدد صور التغرير وتنوع أشكاله. المنهج المتبع في البحث: اتبعت المنهج الوصفي التحليلي، ثمّ المنهج الاستنباطي، أهم نتائج البحث: 1- أن للضمان بسبب التغرير شروطًا يجب إعمالها والنظر فيها عند الحكم بالغرور. 2-بيان اختلاف الفقهاء في تطبيق الغرور في بعض المسائل، نظرًا للاختلاف في وجود بعض الشروط أو الموانع التي تمنع من أحكم بالتغرير. 3- بيان القدر المؤثر من التغرير في العقود. واتفاق فقهاء المذاهب الأربعة على وقوع التغرير بالقول إذا كان مبنيًّا على شرط أو تضمن عقدًا، واختلفوا فيه إذا تجرَّد عن ذلك، وأن الحنفية انفردوا بقولهم: إن الغرور لا يكون إلا في عقود المعاوضة دون بقية المذاهب الذين طردوه في جميع العقود، وغيرها من المسائل. التوصيات: أهمية تقنين أحكام الشريعة الإسلامية في المعاملات المالية؛ لما لهذا من الأثر في "نهضة الأمة وتقدمها" و"استتباب الأمن وشيوع الأمان"، ومن ذلك تقنين أحكام عقود المعاوضات. This research aims to clarify the provisions of deception and its impact on bargaining contracts, especially with the development of life and the change in its patterns, the difference in people’s behavior and morals, and the diversity of trade and exchanges between people, and this has led to the multiplicity of forms of deception and the diversity of its forms. The method followed in the research: I followed the descriptive analytical method, then the deductive method. The most important results of the research: 1- The guarantee due to deception has conditions that must be implemented and considered when ruling on deception. 2- Explaining the difference of jurists in the application of deception in some issues, due to the difference in the presence of some conditions or impediments that prevent someone from ruling on deception. 3- Explaining the effective extent of deception in contracts. The jurists of the four schools of thought agreed that deception occurs in speech if it is based on a condition or includes a contract, and they differed in it if it is independent of that, and that the Hanafis were alone in saying: deception only occurs in compensation contracts, to the exclusion of the rest of the schools of thought who rejected it in all contracts, and other issues. Recommendations: The importance of codifying the provisions of Islamic Sharia in financial transactions; Because of this impact on “the nation’s renaissance and progress” and “the establishment of security and the spread of safety,” including codifying the provisions of compensation contracts. | ||||
