| Abstract | ||||
| يهدف هذا البحث إلى بيان مقصد الشريعة الإسلامية في الحفاظ على كرامة المسلم بالحض على العمل وذم المسألة، وذلك من خلال تعريف احتراف التسول، وبيان أسبابه وطرقه، مع توضيح الأحوال العارضة التي يباح فيها السؤال وحد الغني المانع منه في الفقه الإسلامي، وكذلك تسليط الضوء على بعض الجرائم التي تنطوي عليها هذه المهنة؛ لبيان مخاطرها على المجتمع، كترويج المخدرات، وخطف الأطفال أو استئجارهم، أو إحداث عاهة مستديمة في أجسامهم كأداة للتسول، مع بيان العقوبة المقررة في الفقه الإسلامي والقانون الوضعي، وللبحث عدة نتائج أهمها ما يلي: اتفق الفقهاء على أن احتراف التسول محرم إذا كان الإنسان غنيًا بماله أو صنعته، أو كان قادرًا على الكسب الذي يسد حاجته. يحل سؤال الناس في بعض الأحوال الطارئة بضوابط شرعية . حد الغنى الذي لا يحل معه السؤال وجود الكفاية الدائمة، بأن يكون للإنسان كسب يكفيه ويسد حاجته على المختار من أقوال الفقهاء. أجمع الفقهاء على أن الاتجار في المخدرات وتروجيها من المتسولين أو غيرهم محرم، ويعاقب على ذلك بما يراه القاضي مناسبًا؛ لردعه من ضرب أو حبس أو تغريم أو غيره. خطف الأطفال بغرض استخدامهم في التسول يعتبر حرابة وسعى في الأرض بالفساد؛ لما يسببه من ترويع للآمنين، وتهديد للأمن العام في البلاد. إحداث عاهة مستديمة عمدًا عدوانًا؛ لتسهيل عملية التسول محرم، ويجب فيه القصاص. اتفق الفقهاء على حرمة الاستئجار للعمل في مهنة التسول؛ لأنه وسيلة إلى أمر محرم، والوسائل لها أحكام المقاصد، فلا يجوز الاستئجار على التسول، ولا يحل أخذ الأجرة عليه، ويعاقب بما يراه القاضي مناسبًا لردعه This research aims to explain the purpose of Islamic law in preserving the dignity of the Muslim by encouraging work and condemning begging, by defining the profession of begging, and explaining its reasons and methods, while clarifying the occasional circumstances in which begging is permissible and the rich person prohibiting it in Islamic jurisprudence, as well as shedding light on Crimes involved in this profession; To explain its dangers to society, such as drug trafficking, kidnapping or renting children, or causing a permanent disability in their bodies as a tool for begging, with an explanation of the punishment prescribed in Islamic jurisprudence and positive law. The research has several results, the most important of which are the following: The jurists agreed that professional begging is forbidden if a person is rich in money or work, or is able to earn money that satisfies his needs. It is permissible to ask people in some emergency situations according to Sharia regulations. The limit of wealth for which the question is not resolved is the existence of permanent sufficiency, which is that a person has an income that suffices him and satisfies his need, according to what the jurists have chosen. The jurists unanimously agreed that trafficking in drugs and promoting them by beggars or others is forbidden, and this is punishable by what the judge deems appropriate. To deter him from being beaten, imprisoned, fined, or otherwise. Kidnapping children for the purpose of using them as beggars is considered hostility and seeking corruption on earth. Because of the intimidation it causes to people and the threat to public security in the country. Intentionally causing permanent disability through aggression; To facilitate the process of begging is forbidden, and retribution is required. The jurists agreed on the prohibition of hiring people to work in the profession of begging. Because it is a means to a forbidden matter, and the means have the same rulings as the ends, so it is not permissible to hire someone to beg, and it is not permissible to take wages for him, and he will be punished with whatever the judge deems appropriate to deter him. | ||||
