Abstract | ||||
قد يبدوا من الوهلة الأولى عند مطالعة موضوع الدراسة أن الإشكالية التي سوف تقوم الدراسة بإلقاء الضوء عليها هي كيفية درء المسؤولية الطبية عن الطبيب عند حدوث خطأ في علاج مريض فقر الدم المنجلي, ولكن الحقيقة على العكس من ذلك، فالمقصود من الدراسة هو تحديد التزامات المنظومة الطبية، وأن رفض أو خطأ المريض للعلاج لا يعفيها من المسئولية مطلقا إلا في حدود معينة هذا من وجهة ، ومن وجهة أخرى هي وجوب تحديد التزامات المريض بداية حتى لا يسقط حقه ، وذلك منذ اكتشافه لمرضه مروا بتنمية ثقافته الطبية عن المرض خاصة وأن لهذا المرض طبيعة خاصة في ملازمته له على مدار حياته كمرضى السكرى ... وأخيرا الأثار القانونية التي تنشأ عند الإخلال بالالتزام أثناء تنفيذ العلاج وإيجاد نصوص تشريعية تنظم وتحمي الفلك الذي تدور فيه العملية العلاجية لذا حاولت الدراسة معالجة ذلك من خلال ثلاث مباحث أختص المبحث التمهيدي منها ببيان ماهية مرض فقر الدم المنجلي من حيث الناحية الفسيولوجية البحتة لتوضيح حقيقة هذا المرض، ثم أوضحت الدراسة أساس مسؤولية الطبيب المعالج لمريض فقر الدم المنجلي وطبيعتها في المبحث الأول, وذلك من خلال مطالب ثلاث الأول لبيان أساس انعقاد مسؤولية الطبيب المعالج ، والثاني لتوضيح طبيعة مسئولية الطبيب المعالج ، والثالث لبيان التكييف القانوني لعقد العلاج الطبي بين الطبيب المعالج ومريض فقر الدم المنجلي، وفي المبحث الثاني توصلت الدراسة إلى تحديد الآثار المترتبة عن خطأ مريض فقر الدم المنجلي في حال تعدد المسئولين وذلك من خلال مطالب ثلاثة الأول عن خطأ مريض فقر الدم المنجلي وأثر ذلك على توزيع المسؤولية ، والثاني لبيان دور الدولة والمؤسسات العلاجية تجاه مريض فقر الدم المنجلي، والثالث أثر تعدد المسؤولين على تقدير التعويض ، وانتهت الدراسة بمجموعة من النتائج والتوصيات التي خلصت إليها من خلال البحث However, the truth is to the contrary, the study is intended to determine the obligations of the medical system, and the patient's refusal or error to treat treatment does not relieve her of responsibility at all except in certain limits. This is on one hand, and on the other hand, the obligations of the patient must be defined first, so that he does not lose his right, since he discovered his illness, they have been involved in the development of his medical culture about the disease, especially since this disease has a special nature in keeping with him throughout his life, like diabetics .... and finally, the legal effects that arise when the obligation is violated during the implementation of treatment and the creation of legislative texts that protect the behavior in which the treatment is conducted, so the patient has tried first to address the disease through a statement of research conducted with regard to the disease .... pure psychology to show the reality of this disease, The study then clarified the basis of the responsibility of the doctor treating the sickle-cell anemia patient and its nature in the second research, by three requests: the first to show the basis of the contract of responsibility of the treating doctor, the second to clarify the nature of the responsibility of the treating doctor, the third to show the legal adaptation of the medical treatment contract between the treating doctor and the sickle-cell anemia patient, and in the third study to determine the effects of the sickle-cell anemia patient's fault if there are multiple officials in three demands; the first to explain the fault of the sickle-cell anemia patient and the impact on the distribution of responsibility; and the second to show the role of the state and treatment institutions towards the sickle-cell anemia patient, The study concluded with a set of findings and recommendations from the research | ||||
