| المراقبة الإلكترونية بواسطة السوار الإلكتروني أحد الأساليب المبتكرة لتنفيذ العقوبة، أو الحبس الاحتياطي، خارج أسوار السجن ،بحيث يُسمح لمن يخضع للمراقبة بالبقاء في محل إقامته، مع فرض بعض القيود على تحركاته من خلال جهاز المراقبة الإلكترونية؛ وذلك بقصد حمايته من مخاطر العقوبات السالبة للحرية قصيرة المدة والحبس الاحتياطي، وتمكينه من القيام بواجباته الأسرية أو المجتمعية، وفق ظروف معينة تتفق ومعالم شخصيته، وبالصورة التي تؤدي إلى التأهيل والإصلاح والاندماج المجتمعي، دون سلب حريته، وتطبيقاً لمبدأ "قرينة البراءة لدى المتهم"، ومن شأن هذا الطريقة تغيير سلوكيات المحكوم عليه وإحلال السلوك القويم وضبط النفس وتنمية الوازع الديني وتخليصه من الصدمة النفسية التي قد تصيبه بالبقاء في السجن المغلق وآثاره السلبية على الفرد والمجتمع والدولة، ومن المنظور الفقهي: فإن الشريعة الإسلامية تجيز كل التدابير التي من شأنها أن تحمي منظومة القيم والأخلاق، حراً كان الفرد أو متهما أو محكومًا عليه، فتُضيق من دائرة السجن وتراعي ظروف وشخصية الجاني، وتأمر بالتريث والتمهل في إنزال العقاب قبل ثبوت التهمة، وتوجب إدماج المحكوم عليه في المجتمع، وتحمي كرامته، وتحفظ حقوقه وحقوق أسرته، تحقيقاً للعدالة الجنائية الناجزة. Electronic monitoring via an electronic bracelet is one of the innovative methods for implementing punishment, or pretrial detention, outside prison walls, whereby those who are under surveillance are allowed to remain in their place of residence, while imposing some restrictions on their movements. This method aims to protect them from the risks of short-term custodial sentences and pretrial detention, enables them to carry out their family or community duties in a way consistent with the characteristics of their personalities and leads to rehabilitation, reform and societal integration, without depriving them of their freedom, which is in accordance with the principle of “the accused’s presumption of innocence.” From a jurisprudential perspective: Islamic Sharia permits all measures that would protect the system of values and morals, whether the individual is free, accused, or convicted. It narrows the scope of imprisonment and takes into account the circumstances and personality of the offender. It orders caution and delay in imposing punishment before the charge is proven and requires the convict to be integrated into his society, protect his dignity, and preserve his rights and the rights of his family, in order to achieve complete criminal justice. | ||||
