| Abstract | ||||
| يهدف البحث إلى بيان مرونة الشريعة الإسلامية ومسايرتها للحياة حسب تغير الناس والزمان والمكان، فالأحكام تدور على العلل، وتهدف إلى مقاصد وأهداف، وهذا ما ينعكس على آراء الفقهاء واجتهاداتهم خاصة في مجال سياسة القضاء والفتوى. ونظرية التبريز في الشهادة عند المالكية من هذا القبيل تعالج بعض القضايا المتعلقة بالشهادة من حيث التفرقة بين العدالة والتبريز، وبين المسائل التي تشترط فيها العدالة المجردة، والمسائل التي تشترط فيها العدالة إلى جنب التبريز، ولا تكفي فيها شهادة العدل غير المبرز لاشتراط التبريز فيها. وبيان المقاصد الشرعية منها، وبيان مساهمة التشريع القضائي في حفظ حقوق الناس، وتقويم ومعالجة الثغرات الأخلاقية والسلوكية، وذلك لأن الموضوع شديد الصلة بحياة الناس وأحوالهم وتطور أنماط عيشهم وتعاملاتهم وسلوكياتهم وأخلاقياتهم في الحاضر والمستقبل وفي كل ظرف. The research aims to demonstrate the flexibility of Islamic law and its adaptation to life according to the change of people, time and place. The rulings revolve around causes, and aim at purposes and objectives. And the theory of distinction in the testimony of the Malikis of this kind deals with some issues related to testimony in terms of the distinction between justice and recognition, and between issues in which abstract justice is required, and issues in which justice is required along with recognition, and in which testimony of unexpressed justice is not sufficient to require recognition in it. And a statement of the legitimate purposes of it, and a statement of the contribution of judicial legislation to preserving people’s rights, and correcting and addressing ethical and behavioral gaps, because the issue is closely related to people’s lives and conditions and the development of their lifestyles, dealings, behaviors and ethics in the present and future and in every circumstance. | ||||
