| Abstract | ||||
| يعد ديوان المظالم صاحب الولاية الأصيلة بنظر المنازعات الإدارية إلا أنه خروجًا من هذا الأصل فقد منح المنظم لجنة الفصل في المخالفات والمنازعات التمويلية بعض الاختصاص بنظر المنازعة الإدارية بالنظر بالفصل في تظلُّمات ذوي المصلحة من قرارات البنك المركزي ذات الصلة بالقطاع التمويلي، الأمر الذي تبرز معه المشكلة البحثية، والداعي لبحث اختصاص اللجنة بنظر المنازعة الإدارية، بالتعرّف على اللجنة وطبيعة القرارات الصادرة منها، والتعرف على طبيعة المنازعة الإدارية التي تختصُّ بها، والشروط النظامية المتعلقة بذلك، والتوصل لآلية الفصل في تنازع الاختصاص بين اللجنة وبين ديوان المظالم، وذلك باستخدام المنهج الوصفي التحليلي. وانتهت الدراسة إلى أن لجنة الفصل في المخالفات والمنازعات الإدارية تُعدُّ من اللجان المستثناة، وأن القرارات الصادرة منها قرارات قضائية، لا يجوز بعد اكتسابها القطعية الطعن عليها أمام أي جهة قضائية أخرى، كما توصلت إلى أن اختصاص اللجنة بنظر المنازعة الإدارية منحصر بالفصل في تظلُّمات ذوي المصلحة من قرارات البنك المركزي ذات الصلة بالقطاع التمويلي دون ما عداها من المنازعات الإدارية، وباشتراط التقدم إلى اللجنة للتظلُّم من القرار الإداري خلال (60) يومًا من تاريخ التبليغ بالقرار الإداري، وإلى أن المنظم أوجد آليَّة الفصل في تنازع الاختصاص بين اللجنة وبين ديوان المظالم. وأوصت الدراسة بنشر الأحكام القضائية الصادرة من لجنة الفصل في المخالفات والمنازعات التمويلية وإعداد الدراسات البحثية ذات الصلة. Abstract: The Board of Grievances is considered to have the original mandate to hear administrative disputes. However, as a departure from this principle, the regulator has granted the Committee for Resolution of Violations and Financing Disputes some jurisdiction to hear administrative disputes by considering the grievances of stakeholders regarding the decisions of the Central Bank related to the financial sector, which raises the research problem. The call for examining the committee’s jurisdiction to consider administrative disputes is to learn about the committee and the nature of the decisions issued by it, to learn about the nature of the administrative dispute that it specializes in, and the legal conditions related to that, and to reach at a mechanism for resolving the conflict of jurisdiction between the committee and the Board of Grievances, using the descriptive and analytical approach. The study concluded that the Committee for Resolving Administrative Violations and Disputes is considered one of the excluded committees, and that the decisions issued by it are judicial decisions, which after becoming final may not be appealed before any other judicial authority. It also concluded that the Committee’s jurisdiction to consider administrative disputes is limited to adjudicating the grievances of stakeholders. And the decisions of the Central Bank related to the financial sector, excluding other administrative disputes, and the requirement to submit a grievance against the administrative decision to the committee within (60) days from the date of notification of the administrative decision, and until the regulator has created a mechanism for resolving the conflict of jurisdiction between the committee and the Board of Grievances. The study recommended publishing the judicial rulings issued by the Committee for Resolving Financing Violations and Disputes and preparing relevant research studies. | ||||
