| Abstract | ||||
| شرع الله سبحانه وتعالى الأحكام لمقاصد وغايات تكون هي الأصل في التعامل، ولكن أحيانا يعتري الحكم الأصلي بعض الاستثناءات فتأخذ حكما آخر، وهذا لا يختلف حقيقة مع مقاصد الشريعة، كما أنه لا يختلف أيضا مع الغرض الأصلي من مشروعية المسألة بل علي العكس قد تكون تقوية لها وتأصيلا لمشروعيتها. وكثيرا ما نجد ذلك في الأبواب الفقهية فما من موضوع فقهي إلا وله استثناءات ونجدها في مجملها متوافقة مع الحكم الأصلي ومع مقاصد التشريع لذا وقع الاختيار على موضوع "توافق الأصل والاستثناء مع مقاصد الشريعة دراسة أصولية تطبيقية" وتهدف الدراسة إلى إبراز الحكم الأصلي والحكم الاستثنائي لبعض القضايا المعاصرة وبيان مدي ملاءمة كل منهما لمقصد الشريعة، ولا يخفى ما لدراسة النوازل من أهمية في إظهار الحكم الشرعي لها وبيان كمال الشريعة للعالم أجمع، وصلاحها لكل زمان ومكان وسأتبع في دراسة هذا الموضوع أكثر من منهج (المنهج الاستقرائي للوصول إلى تلك الأحكام ومعرفة الأحكام الأصلية فيه، والمنهج التحليلي في المسائل المستثناة، والمنهج التطبيقي في بيان مدى مطابقة المسائل المستثناة لمقاصد التشريع). من أهم النتائج التي تم التوصل إليها هو توافق الأصل والاستثناء مع مقاصد الشريعة في جميع الموضوعات التي تم طرحها. Abstract: Allah, glorified and exalted, has legislated rulings based on purposes and interests that serve as the foundation for interactions. However, sometimes the original ruling is subject to exceptions, resulting in a different ruling. This does not contradict the purposes of Islamic law; rather, it aligns with the original objective of legitimizing the matter. Exceptions can strengthen and solidify the legitimacy of a given issue. This phenomenon is widespread in the rulings of Islamic law. Every legal issue or topic is accompanied by exceptions that are consistent with the original ruling and the purposes of legislation. In this regard, we will follow multiple approaches: first, the inductive approach to reach those rulings and identify their original rulings; second, the analytical approach to address exceptional cases; and finally, the applied approach to demonstrate the extent of compatibility between exceptional cases and the purposes of legislation. Throughout this study, we will explore numerous contemporary issues in which the compatibility of the original ruling and the exception becomes evident, clearly aligning with the purposes of Islamic law. | ||||
