| Abstract | ||||
| في ظل انتشار العمل الحر عبر شبكة الإنترنت على الصعيدين الدولي والمحلي وظهور العديد من الصور الخاصة به حتى كثرت وتشعبت، وقد نشأت هذه الصور في الغرب دون مراجعة شرعية لها توضح المباح منها وغيره؛ الأمر الذي حملني على أن أتناول هذا الموضوع مبينا مفاهيم البحث، وكذلك أركان العمل الحر عبر الإنترنت، والفرق بينه وبين العمل عن بعد، وأهمية منصات العمل الحر، وأمثلة على تلك المنصات. وكذلك إيجابيات وسلبيات العمل الحرّ عبر الانترنت. تم تطرقت إلى مجالات العمل الحر عبر الإنترنت، فتحدثت عن مجال الدعاية والإعلان، ومجال التقنية الحديثة، والمجال العلمي والأدبي، وغيرها. ثم انتهيت إلى بيان الضوابط الشرعية للعمل الحر عبر شبكة الإنترنت؛ وحيث إن العمل الحر يتم فيه بيع الخدمات قمت بتناول الضوابط الشرعية للبيع بشكل عام ثم طبقتها على مجالات العمل الحر حتى أصل إلى المقصود. وقد توصل البحث إلى بعض النتائج أهمها: أنه حتى تبقى المعاملات المالية وما يترتب عليها من ربح على إباحتها الأصلية لا بد من توافر ضوابط الربح العامة، وأن هناك بعض الصور المحرمة للعمل الحر عبر شبكة الإنترنت يمكن تحويلها إلى صور مباحة إذا أمكن تغيير بعض الأمور فيها. كما أوصى البحث بتفعيل دور الرقابة الدينية على طرق الربح والتي أغلبها يأتي من الخارج دون ضوابط شرعية. كما أوصى أن تصنع الدول الإسلامية مؤسسات ربحية وسيطة ذات مرجعية دينية تقوم بجمع الوظائف المتاحة والمباحة على الشبكة والإعلان عن قبول مستقلين للتوظيف بها. Abstract: In light of the spread of freelancing through the Internet at the international and local levels and the emergence of many images of it that have become numerous and widespread, these images have arisen in the West without a legal review of them clarifying what is permissible and what is not; Which led me to address this topic, explaining the research concepts, as well as the pillars of freelancing online, the difference between it and remote work, the importance of freelancing platforms, and examples of those platforms. As well as the pros and cons of freelancing online. The fields of freelancing via the Internet were touched upon, and I talked about the field of advertising, the field of modern technology, the scientific and literary field, and others. Then I concluded by explaining the legal controls for freelancing on the Internet. Since self-employment involves selling services, I discussed the legal controls for selling in general and then applied them to the areas of self-employment until I reached the point. The research reached some results, the most important of which are: In order for financial transactions and the resulting profits to remain as permissible as they were originally, general profit controls must be in place, and that there are some forbidden images of self-employment on the Internet that can be converted into permissible images if some things in them can be changed. . The research also recommended activating the role of religious oversight over methods of profit, most of which come from abroad without legal controls. He also recommended that Islamic countries create intermediary profit-making institutions with a religious reference that collect available jobs available on the Internet and announce the acceptance of freelancers for employment in them. | ||||
