| Abstract | ||||
| قمت فى هذا البحث بالحديث عن "الاستغلال المالي للزوجة العاملة دراسة فقهية مقارنة" ،وبيان الذمة المالية المنفصلة للزوجة والتأكيد على انفصال الذمة المالية بين الزوجين ،فلا سلطان للزوج على تصرفات الزوجة المالية ،وللزوجة أن تتصرف بهذه الذمة المالية تمام التصرف دون أن يسألها الرجل ،كما قمت ببيان واجبات الزوج في النفقة من ذمته المالية الخاصة ،وبيان مدى جواز إجبار الزوج لزوجته على اقتسام راتبها ،أو أخذه من مالها ، وأن راتبها حق لها, ولا يجوز للرجل أن ينظر إلى مالها أو يأخذ منه،إلا إذا تم الاتفاق على ذلك عند عقد النكاح ،كما بينت حكم إجبار الزوج لزوجته على بيع ذهبها ، سواء أكان هذا الذهب على سبيل الهدية ،أم على سبيل المهر، .وأن الذهب الذي أعطاه الزوج لزوجته يُعَدُّ من المهر الذى تستحق نصفَه بمجرد العقد، وتستحق كامله بتمامه بالدخول، وليس للزوج أن يأخذه منها رغمًا عنها أو دون علمها،وكذلك الهدية لا يحق له الأخذ منها ،فهي تعد بمثابة الهبة،كما لا يحق له إجبارها على التقاعد عن العمل ،أو منعه الإنفاق عليها اكتفاءً بعملها ،كما هو الواقع المعاصر لدى الكثير من الأزواج والزوجات ، كما أنها ليست ملزمة بالإنفاق من مالها على البيت أو الأولاد ،بل على الزوج أن ينفق عليها وعلى أولادها.،كما قمت ببيان التكييف الفقهي لما تقدمه الزوجة للإنفاق عند إعسار الزوج ،وأنه يكون من باب القرض للزوج تتبع به ذمته عند اليسار،ولا يسقط إلا بالاداء أو الابراء. Abstract: In this research, I talked about "Financial Exploitation of the Working Wife: A Comparative Jurisprudential Study," and explained the separate financial liability of the wife and emphasized the separation of financial liability between the spouses. The husband has no authority over the wife’s financial actions, and the wife has the right to dispose of this financial liability completely without the man asking her, just as I have explained the husband’s duties in alimony from his own financial assets, and explained the extent to which it is permissible for the husband to force his wife to divide her salary, or take it from her money, and that her salary is her right, and it is not permissible for a man to look at her money or take from it, unless this was agreed upon upon contract. Marriage. I also explained the ruling on a husband forcing his wife to sell her gold, whether this gold is as a gift or not. By way of dowry, the gold that the husband gave to his wife is considered a dowry, half of which she is entitled to once the contract is concluded, and she is entitled to it in full upon consummation. The husband does not have the right to take it from her against her will or without her knowledge. Likewise, a gift is not entitled to be taken from her, as it is considered a gift, just as it is not He has the right to force her to retire from work, or to prevent him from spending on her as long as she is satisfied with her work, as is the contemporary reality for many husbands and wives. She is also not obligated to spend her money on the house or the children. Rather, the husband has to spend on her and her children. I also explained the jurisprudential conditioning of what the wife provides for support in the event of the husband’s insolvency, and that it is a loan to the husband, with which his liability is traceable to the left, and it is not dropped except by payment or release. | ||||
