| Abstract | ||||
| المرابحة للآمر بالشراء -دراسة فقهية-، بحثٌ يتناول دراسة فقهية لأنواع المرابحة للآمر بالشراء، مع دراسة الدوافع والآثار لهذه المعاملة، ويندرج تحت المنهج الوصفي التحليلي. والبحث يتكون من ثلاثة مباحث: المبحث الأول: في المرابحة البسيطة، والمبحث الثاني: في بيع المرابحة للآمر بالشراء، والمبحث الثالث: في صور المرابحة المركبة والدوافع والآثــــار لبيع المرابحة المركبة. وهذا البحث يهدف إلى دراسة معاملة المرابحة للآمر بالشراء البسيطة والمركبة دراسة فقهية معاصرة، بمعرفة تعريفه وصورته وحكمه وبيان القول الراجح فيه، وتكييف المرابحة للآمر بالشراء تكييفاً فقهياً، وبيان الدوافع والآثار لبيع المرابحة للآمر بالشراء. ومن النتائج التي ظهرت للباحث في هذا البحث: استحواذ المرابحة المركبة كأسلوب تمويلي على 70% من إجمالي حجم التمويل والائتمان في المصارف الإسلامية وذلك بسبب توافقها مع طبيعة أعمال المصارف وسهولة تطبيقها، ومصطلح المرابحة للآمر بالشراء مصطلح حديث من جهة اللفظ وأما معناه فهو متعامل به منذ القدم، وبيع المرابحة من بيوع الأمانة التي يعتمد فيها المشتري على أمانة البائع، والمرابحة البسيطة تكون بين طرفين هما البائع والمشتري، وقد اجمع العلماء على جوازها، وأما المرابحة المركبة فتكون بين ثلاثة أطراف هم الآمر بالشراء، والمأمور، والبائع الأول للسلعة، وتعددت صور المرابحة المركبة، ويمكن حصرها في ثلاث صور ذكرتها في البحث. Murabaha to the purchase orderer - a jurisprudential study -, a research that deals with a jurisprudential study of the types of Murabaha to the purchase orderer, with a study of the motives and effects of this transaction, and falls under the descriptive analytical approach. The research consists of three sections: the first section: on simple Murabahah, the second section: on the Murabahah sale to the person ordering the purchase, and the third section: on the forms of complex Murabahah and the motives and effects of the complex Murabahah sale. Among the results that appeared to the researcher in this research: Compound Murabaha as a financing method acquired 70%. of the total volume of financing and credit in Islamic banks because of its compatibility with the nature of banking business and the ease of its application. The term “Murabaha” for the one who orders the purchase is a modern term in terms of pronunciation, but its meaning has been dealt with since ancient times. “Murabaha” sales are among the trust sales in which the buyer relies on the seller’s honesty, and simple “Murabaha” It is between two parties, the seller and the buyer, and scholars have unanimously agreed that it is permissible. As for the complex murabaha, it is between three parties: the person who ordered the purchase, the commander, and the first seller of the commodity. There are many forms of complex murabaha, and it can be limited to three forms that I mentioned in the research. | ||||
