Abstract | ||||
There is no doubt that justice is not complete unless the public employee has the right to defence On his behalf before the investigating authorities, this right is one of the rights established in most cases Constitutions of the world. In this research, I discussed the concept of the right to defense, as there were many definitions for it, and I concluded that the right to defense is a set of mechanisms approved by the legal system and used by the accused himself or through a female lawyer to defend himself. The charges brought against him by restricting their evidence or by proving his innocence by establishing Evidence of its opposite in order to uncover the truth and achieve justice. It also discussed the characteristics of the right to defense, as well as the right to defense in the constitution Egyptian and how to express the right of defense. In the second section, I also discussed the controls for implementing the right of a person to suffer from his right to The assistance of a lawyer and the impartiality and independence of the investigator. It also addressed the requirement of impartiality in the investigation in order to guarantee independence. Likewise, replacing the requirement of impartiality in the investigation in order to ensure the independence of investigators... and God grant us success. | ||||
