| Abstract | ||||
| يهدف هذا البحث إلى بيان تخصيص العام بخبر الواحد والقراءة الشاذة، وبيان موقف الأصوليين من ذلك، وقد اتبعت في هذا البحث المنهج الاستقرائي التحليلي، وقسمته إلى مقدمة وخمسة مباحث وخاتمة، تناولت في المقدمة أهمية الموضوع، وخطة البحث، والمنهج المتبع فيه. وفي المبحث الأول تناولت تعريف العام وأنواعه ودلالته، وتعريف الخاص والتخصيص وأنواع المخصصات. وفي المبحث الثاني تناولت التعريف بخبر الواحد، وموقف الأصوليين من تخصيص العام بخبر الواحد. وفي المبحث الثالث تناولت مسائل تطبيقية في تخصيص العام بخبر الواحد، وبيان الآثار الفقهية المترتبة على الخلاف في تخصيص العام بخبر الواحد، وفي المبحث الرابع تناولت التعريف بالقراءة الشاذة وأنواعها، وموقف الأصوليين من تخصيص العام بالقراءة الشاذة، وفي المبحث الخامس تناولت مسائل تطبيقية في تخصيص العام بالقراءة الشاذة، وبيان الآثار الفقهية المترتبة على الخلاف في القراءة الشاذة. وقد خلص البحث إلى مجموعة من النتائج أهمها: أن العام والخاص أصل عظيم من أصول الفقه، وذلك لأثرها في فهم نصوص الكتاب والسنة، واستنباط الأحكام الشرعية من الأدلة، وأن العام الوارد في القرآن الكريم لا يجوز تخصيصه بخبر الواحد، هذا عند الحنفية. أما عند الجمهور فإن العام الوارد في القرآن الكريم يخصص بخبر الواحد، وأن تخصيص العام بخبر الواحد والقراءة الشاذة عمل بالدليلين معًا، وأن للقراءة الشاذة أثر ظاهر في التفسير، وفي بيان بعض الأحكام الشرعية، وأن الاختلاف الحاصل في المسـألة لـيس خلافـًا نظريـًا، بـل ترتـب عليـه خـلاف في الأحكام والفروع الفقهية. This research aims to show the allocation of the year news of the one and abnormal reading, and the statement of the position of the fundamentalists of it, has followed in this research inductive analytical approach, and divided into an introduction and five sections and conclusion, dealt with in the introduction to the importance of the subject, and the research plan, and the approach followed in it. In the first section, I dealt with the definition of the year, its types and significance, and the definition of the private, allocation and types of allocations. In the second section, I dealt with the definition of the news of the one, and the position of the fundamentalists of allocating the year with the news of the one. In the third section, I dealt with applied issues in the allocation of the year with the news of one, and the statement of the jurisprudential effects of the dispute in the allocation of the year with the news of the one, and mentioned five issues: The first issue: cutting off the hand of the thief. The second issue is the inheritance of children. The third issue is the prohibition of combining a woman with her aunt or uncle. And the fourth issue: reading Al-Fatihah in prayer. The fifth issue is the legalization of the dead of the sea. In the fourth section, it dealt with the definition of abnormal reading and its types, and the position of the fundamentalists of allocating the year with abnormal reading, and in the fifth section dealt with applied issues in the allocation of the year with abnormal reading, and the statement of the jurisprudential effects of the dispute in abnormal reading, the research has concluded a set of results, the most important of which are: that the public and private great asset of jurisprudence, because of its impact on understanding the texts of the Book and the Sunnah, and the deduction of legal provisions from the evidence, and that the year contained in the Holy Qur'an may not be allocated with the news of the one, this At the tap.
