| Abstract | ||||
| اعتنى هذا البحث بدراسة العفو عند الأصوليين بنوعيه العام وهو مخالفة مقتضى خطاب الشارع بإذن منه تيسيرا على المكلفين، والخاص وهو السكوت عن حكم الفعل بحيث لا يتعرض له الشرع بلفظ يخص عينه ولا جنسه، فيكون المعفو عنه مما لم تشمله دلالة لفظية ولا قياسية. ثم تحدث عن بعض المصطلحات ذات الصلة بالعفو وعلاقته بها وتناول أدلة المثبتين لمرتبة العفو والنافين لها، ثم مواقع العفو في الشريعة الإسلامية، مفصلا القول في السكوت وأنواعه حتى يتبين النوع المقصود به العفو. وقد خلص البحث إلى نتائج منها: أن العفو والإباحة يجتمعان في رفع الإثم واللوم عن الآخذ بهما، وكذلك عن تاركهما، ويفترقان في أن المباح متساوي الفعل والترك، أما العفو فإن جانب الترك أقرب فيه من جانب الفعل، وفي أن رفع المباح نسخ، أما العفو فإنه ابتداء تحريم أو إيجاب. ومنها أن بين العفو والرخصة عموم وخصوص وجهي، فالرخصة أعم لتنوعها إلى الواجبة والمندوبة والمباحة وخلاف الأولى، أما العفو فإنه لا يخرج عن دائرة الإباحة، والعفو أعم لتحققه في مواضع عدة في الشرع، منها الرخص، فهي أحد تطبيقاته. وأن حصر الأحكام الشرعية في عدد ليس منه مرتبة العفو لا يعني إلغاء وجودها، ولا أنها ليست من حكم الشرع؛ فإذا كان الحكم الشرعي هو خطاب الله تعالى المتعلق بأفعال المكلفين، فإن الخطابات الواردة من الشارع والتي تنص على العفو صراحة، وأن المسكوت عنه مما عفي عنه، دليل على أن السكوت مقصود للشارع، وهو متعلق بأفعال المكلفين، وإن كان لم يتعلق بها حكم خاص بالوجوب أو الاستحباب أو التحريم أو الكراهة، لكن تعلق بها الحكم العام وهو الإذن ورفع الحرج المعبر عنه بالعفو. وأن مواقع العفو في الشريعة عديدة ومتنوعة، منها: العمل بأحد الدليلين المتزاحمين مع كون مقتضى المتروك قويا، كالعمل بدليل العزيمة وإن كان لدليل الرخصة ظهور قوي، أو العمل بدليل الرخصة وإن كان لدليل العزيمة ظهور قوي، ومنها: المخطئ في اجتهاده إذا لم يدخر وسعا في طلب الحكم، ومنها: الخطأ والنسيان والإكراه بتفصيل في كل منهم، وكذلك مقتضى الدليل المرجوح حال القول ببقاء الاقتضاء فيه وكونه في حكم الثابت، This research took care of the study of pardon when fundamentalists of both types of general, which is a violation of the requirement of street speech with his permission to facilitate the taxpayers, and private, which is silence about the rule of the act so that the law is not exposed to the word belongs to his eye or gender, so be pardoned from what was not covered by the verbal significance nor standard. hen he talked about some terms related to pardon and its relationship to it and dealt with the evidence of those who prove the rank of pardon and those who deny it, then the sites of pardon in Islamic law, detailing the saying in silence and its types until it becomes clear what type is meant by pardon. The research has concluded the results, including: that pardon and permissibility meet in the lifting of sin and blame for the taker them, as well as for the abandoner, and separate in that the permissible equal act and abandonment, but pardon the side of the Turk closer to the side of the act, and in that the lifting of the permissible copy, but pardon it is the beginning of prohibition or affirmative. Including that between the pardon and the license is general and specific to my face, the license is more general because of its diversity into obligatory, delegated and permissible Unlike the former, as for amnesty, it does not depart from the circle of permissibility, and pardon is more general because it is achieved in several places in Sharia, including licenses, which is one of its applications. If the legal ruling is the speech of God Almighty related to the actions of the taxpayers, then the letters received from the street that explicitly stipulate pardon, and that the silence of what was pardoned, is evidence that silence is intended for the street, and it is related to the actions of the taxpayers, even if it is not related to a special provision of obligation, mustahabb, prohibition or hatred, but the ruling is attached to it. General which is the permission and lifting of the embarrassment expressed by pardon.
