| Abstract | ||||
| يهدف هذا البحث بيان القواعد المنظمة لحق الاستعانة بمحام، ومعرفة مدي فاعليتها في تمكين المتهم من الاستعانة بمحام في مرحلة ما قبل المحاكمة، وذلك للوصول إلى نقطة توازن بين حق المتهم في الدفاع عن نفسه أو الاستعانة بمحام يدافع عنه وبين حق المجتمع في القصاص من الجاني، ولتناول هذا الموضوع تم تقسيمه إلى ثلاثة مباحث، التمهيدي عرضنا فيه التعريف بالمتهم، وطبيعة حق الاستعانة بمحام وأهميته، والمبحث الأول خصصناه لحق الاستعانة بمحام في مرحلة الاستدلال، أما المبحث الثاني فتناولنا فيه نطاق حق الاستعانة بمحام في مرحلة التحقيق الابتدائي والقيود الواردة عليه. وتوصلنا لعدد النتائج أهمها: لم يرد نص في التشريع المصري والاتحادي والإنجليزي يلزم رجل الشرطة بالتنبيه على المتهم بحقه في الاستعانة بمحام، إنما ترك هذا الأمر للمتهم إذا رغب في طلب المساعدة القانونية. في مصر لم ينص القانون المصري صراحة على عدم أحقية المتهم في الاستعانة بمحام في مرحلة جمع الاستدلال. كما أنه ليس في القانون الإماراتي نص يوجب على المحقق دعوة محامي المتهم لحضور استجوابه. This research aims to clarify the rules governing the right to seek the assistance of a lawyer, and to know the extent of their effectiveness in enabling the accused to seek the assistance of a lawyer at the pre-trial stage, in order to reach a point of balance between the right of the accused to defend himself or the use of a lawyer to defend him and the right of society to retribution from the offender, and to address this topic has been divided into three sections, the preliminary we presented the definition of the accused, and the nature of the right to use a lawyer and its importance, and the first section we devoted to the right to seek the help of a lawyer at the stage of inference, either The second section dealt with the scope of the right to seek the assistance of a lawyer at the stage of the preliminary investigation and the restrictions contained therein. We reached a number of results, the most important of which are: There is no provision in the Egyptian, federal and English legislation obliging the policeman to alert the accused His right to a lawyer is left to the defendant if he wishes to seek legal aid. In Egypt, Egyptian law does not explicitly state that the accused is not entitled to a lawyer at the stage of gathering evidence. There is also no provision in UAE law that requires an investigator to invite the defendant's lawyer to attend his interrogation. | ||||
