| Abstract | ||||
| لأهمية علم أصول الفقه بين العلوم الشرعية اعتنى العلماء به عناية عظيمة, فصنفوا فيه المصنفات الكثيرة والمتنوعة من مختصرات, ومطولات, وشروح, وحواشي, ومن بين هؤلاء العلماء الإمام أبو نعيم أحمد بن مصطفى بن عثمان الخادمي المتوفى سنة (1165هـ), فقد أفاد وأجاد في علم أصول الفقه بكتابة مرقاة الحصول حاشية على مرآة الأصول، وذلك بالشرح والتعليق على كتاب مرآة الأصول، ويعرض هذا البحث اعتراضات أبي نعيم الخادمي في حاشيته "مرقاة الحصول”على الملا خسرو مؤلف مرآة الأصول في باب القياس من خلال مقدمة، وخمسة مباحث وخاتمة: المقدمة: في أهمية الحاشية، ومكانتها العلمية, والمبحث الأول: التعريف بالملا خسرو, والمبحث الثاني: في التعريف بأبي نعيم الخادمي, وجاء المبحث الثالث: في تحقيق عنوان الحاشية، ونسبتها لمؤلفها. أما المبحث الرابع فكان في : سبب تأليف الكتاب، وتاريخه وجاء المبحث الخامس مشتملا على: اعتراضات الخادمي الواردة في باب القياس على الملا خسرو, وقد ختمت البحث بحاتمة فيها أهم النتائج ومنها: أن الخادمي رحمه الله شخصيته الأصولية تتجلى في طريقته في التأليف ومنهجه في تناول القضايا وترجيحه لمسائل مخالفًا لما ذهب إليه ملا خسرو رحمة الله، فليس الخادمي رحمه الله مقلدًا، بل كان باحثًا ناقدًا له اختياراته وترجيحاته, وأن مخالفات الخادمي لملا خسرو رحمهما الله يرجع سببها إلى اختلاف ما يظهر له ويترجح عنده من الأدلة في كل مسألة, وقد بلغ مجموع المسائل التي اعترض عليها الخادمي في باب القياس خمس مسائل متفرقة في موضوعات القياس. Abstract: For the importance of the science of jurisprudence among the legal sciences took great care of the scholars, they classified the many and varied works of abbreviations, lengths, explanations, and footnotes, and among these scholars Imam Abu Naim Ahmed bin Mustafa bin Othman Khadimi died in (1165 e), it has reported and shred in the science of jurisprudence by writing a footnote to get a footnote on the mirror of assets, by explaining and commenting on the book Mirror assets, and this research presents the objections of Abu Naim Khadimi in his footnote "Marqat get”on Mullah Khusraw author mirror The origins in the chapter on measurement through an introduction, five sections and a conclusion: Introduction: In the importance of the footnote, and its scientific status, and the first topic: the definition of Mullah Khusraw, and the second topic: in the definition of Abu Naim Khadimi, and the third section: in the achievement of the title of the footnote, and its attribution to its author The fourth section was in: the reason for writing the book, and its history The fifth section came to include: Khadimi's objections contained in the section of analogy to Mullah Khusraw, has concluded the research with a certain most important results, including: that Khadimi, may God have mercy on him, his fundamentalist personality is reflected in his way of authorship and his approach to dealing with issues and weighting issues contrary to what he went to Mullah Khusraw, may God have mercy on him, is not Khadimi, may God have mercy on him, but was a critical researcher with his choices and preferences, And that the violations of Khadimi to Mullah Khusraw may God have mercy on them is due to the difference in what appears to him and is likely to have evidence in each issue, and the total issues objected to by Khadimi in the section of measurement five separate issues in the topics of measurement. | ||||
