Abstract
اقتضت حكمة الله سبحانه وتعالى أن يوجب دفع المهر للمرأة المتزوجة، فجاءت هذه الدراسة لتتناول الحكم المترتب على كون المهر متسلما لدى المرأة منذ العقد، فذهب الجمهور إلى أن المهر يكون كله ملكا للزوجة بالعقد، فإذا طلقها قبل الدخول استرجع نصف المهر، وبناء عليه فإن الزكاة تجب عليها في جميع المهر وتخرج الزكاة منه بعد تمام الحول، فإذا طلقها قبل الدخول كان له حق المطالبة برد نصف المهر كاملا، وتكون الزكاة من حسابها، وذهب المالكية وبعض الإباضية إلى أن المرأة تملك نصف المهر بالعقد ويكون النصف الثاني أمانة في يدها، وبناء عليه تجب عليها الزكاة في نصف المهر إن حال عليها الحول قبل الدخول بها، وتكون زكاة النصف الثاني على زوجها، ومن العلماء من ذهب إلى أنها تملك نصف المهر بالعقد، ويكون ملكها للنصف الثاني موقوفا على الدخول بها ونحوه جمعا بين القولين الأولين، وبناء عليه فإنها تبدأ حساب الزكاة تحسب بالعقد، فإذا دخل بها قبل تمام الحول، فإنها تزكي عن الجميع، وإن لم يدخل بها قبل تمام الحول، فإنها تزكي عن النصف، فإذا دخل بها زكت عما مضى، وإن لم يدخل بها وطلقها دفعت النصف الثاني إليه، وذهب بعض العلماء إلى أن المرأة تملكه كله بالعقد ولكن يسقط حقها من المهر كله إن طلقها قبل الدخول، ويحكم لها بنصفه من طريق المتعة، وبناء عليه فإنها تخرج الزكاة عن كامل المهر إن أكملت الحول دون أن يطلقها، فإن طلقها قبل تمام الحول سقطت ملكيتها لما سبق وتبدأ حسابا جديدا بعد الطلاق.
 
Abstract:
The wisdom of God Almighty required that the dowry must be paid to a married woman, so this study came to address the ruling resulting from the fact that the dowry is received by the woman since the contract, so the public went to the fact that the dowry is all owned by the wife by contract, if he divorces her before entering he recovers half of the dowry, and accordingly, the zakat is due in all the dowry and zakat comes out of it after the completion of the year, if he divorced her before entering he had the right to claim the full refund of half of the dowry, and the zakat is from her account, and the Malikis went Some Ibadis pointed out that a woman owns half of the dowry in the contract and the second half is a trust in her hand, and accordingly she must pay zakat on half of the dowry if it is forbidden for her to squint before entering into it, and the zakat of the second half is on her husband, and from the scholars who went to She owns half of the dowry in the contract, and her property for the second half is dependent on entering into it and the like in combination of the first two sayings, and accordingly it begins to calculate zakat calculated by the contract, and if he enters it before the completion of the year, she pays zakat on behalf of everyone, and if he does not enter it before the completion of the year, she pays for the half, and if he enters into it, she pays zakat for what was past, and if he does not enter it and divorces her, she pays the second half to him, and some scholars went that the woman owns it in its entirety by contract, but her right is forfeited from The whole dowry if he divorces her before consummation, and she is sentenced to half of it by way of pleasure, and accordingly she pays zakaah on the entire dowry if she completes the squint without divorcing her, if he divorces her before the full squint, her ownership of the above is forfeited and she starts a new account after the divorce.
