Abstract | ||||
مما لا شك فيه أن للإدارة في ممارسة كل أعمالها امتيازات كثيرة يظهر فيها طابع السلطة العامة، وتلجأ في ممارسة نشاطها إلى وسائل متعددة ومتنوعة مما يعرف بأعمال الإدارة، وهذه الأخيرة قد تكون إعمالاً مادية أو تصرفات قانونية ،والتي بدورها تنقسم إلى تصرفات من جانب واحد والمعروفة بالقرارات الإدارية، وتصرفات اتفاقية تسمى بالعقود الإدارية. ويعتبر العقد الإداري من الأعمال القانونية التي تمارسها الإدارة لتنفيذ التزامها الأساسي بتحقيق المصلحة العامة، ولا تخضع العقود الإدارية التي تقوم الإدارة بإبرامها عادة لنظام قانوني واحد، فمنها ما يخضع للقانون العام ومنها ما يخضع للقانون الخاص، فالعقود التي تبرمها الإدارة بقصد تسيير مرفق عام أو تنظيمه مع انتهاج أسلوب القانون العام يطلق عليها العقود الإدارية، والتي يختص القضاء الإداري بالنظر في المنازعات الناشئة عنها، منازعاتها القضاء الإداري، وأما العقود التي تبرمها الإدارة ليس بوصفها سلطة عامة وتتبع وسائل القانون الخاص، فإن هذا النوع من العقود يطلق عليه عقود الإدارة المدنية، والقضاء العادي هو الذي يختص بالنظر في المنازعات الناجمة عنها، وإن كان القضاء الإداري هو المختص بالنظر في منازعات العقود الإدارية، ولكن في هذه الحالة يثار تساؤل حول هذا الاختصاص وما هي حدوده؟ وما هي طبيعة هذه الولاية للقضاء الإداري على العقود الإدارية؟ وهذا ما سيعالجه هذا البحث There is no doubt that the administration, in the exercise of all its work, has many privileges in which the character of public authority appears, and in the exercise of its activity it resorts to multiple and varied means known as administrative work, and the latter may be material work or legal actions, which in turn are divided into unilateral actions known as administrative decisions, and contractual actions called administrative contracts. The administrative contract is considered one of the legal acts practiced by the administration to implement its basic commitment to achieve the public interest. The administrative contracts concluded by the administration are not usually subject to a single legal system. Some of them are subject to public law and some are subject to private law. Contracts concluded by the administration with the intention of managing or organizing a public facility while adopting the public law method are called administrative contracts, and the administrative judiciary is competent to consider disputes arising from them. Their disputes are administrative judiciary disputes. As for contracts concluded by the administration not in its capacity as a public authority and follow the means of private law, this type of contract is called civil administration contracts, and the ordinary judiciary is the one competent to consider disputes arising from them, although the administrative judiciary is competent to consider disputes over administrative contracts. However, in this case, a question arises about this competence and what are its limits? What is the nature of this jurisdiction of the administrative judiciary over administrative contracts? This is what this research will address. | ||||
