Abstract | ||||
يهدف هذا البحث إلى إبرازالمسائل التي خالف فيها الطوفي مذهب الحنابلة، وتكمن إشكالية البحث حول حصر الاختيارات الفقهية لنجم الدين الطوفي في كتابه مختصر الترمذي، وبيان مدى موافقته لمعتمد مذهب الحنابلة، واتبعت في هذا البحث المنهج الاستقرائي والمنهج التحليلي، وتوصل البحث إلى أن الطوفي سلك منهج الاختصار والإيجاز، وأنه في الغالب موافقٌ لمعتمد مذهب الحنابلة، كما أنه خالف في بعض المسائل مما يدل على أنه غير متعصب لمذهب الحنابلة. وقد توصلت الدراسة للنتائج التالية: 1- سلك الإمام الطوفي منهج الاختصار والإيجاز. 2- علق الإمام الطوفي على الأحاديث بما يتناسب مع المقام، فأحيانا التزم الإيجاز، وأخرى الإسهاب بأسلوب واضح. 3- قام في كتابه مختصر الترمذي على اختصار الأسانيد، بغرض التسهيل والحفظ. 4- والتزم إيراد متن الترمذي – غالباً. 5- اهتم الطوفي - غالبا-بفقه الحديث، مع بيان العلل. 6- أزال بعض الإبهامات، من خلال الجانب اللغوي. 7- يوافق العلامة الطوفي غالباً جمهور أهل العلم في قواعد وضوابط العمل في التوفيق بين الأحاديث المتعارضة في المنهج التقعيدي. 8- في الغالب أنه يقدّم القول بالجمع بين الأحاديث المتعارضة، ثم النسخ، ثم الترجيح، وفي تطبيقه لهذه القواعد قد يخالف في تفاصيلها، فيعمل بخلاف هذا الترتيب لدليلٍ أو قرينةٍ يراها مرجحة لما ذهب إليه. 9- قد يجمع بين الأحاديث بجمعٍ لم يسبق إليه، ومن ذلك أنه قد يرجّح قولاً يخالف مذهب إمامه الفقهي، وهذا مما أثري هذا العلم المهم . Abstract: This research aims to study some of the jurisprudential choices of Najmuddin al-Tawfi (d. 716 AH) in his book "Mukhtasar al-Tirmidhi" (d. 279 AH), and I show whether al-Tawfi's choices are consistent with what is approved from the Hanbali school of thought, then I study the jurisprudential issue in a comparative study, according to the known scientific methods, and discuss the evidence, and then the preference. The importance of this research is due to: Combining the hadith and the jurisprudential sayings of scholars, which enriches the student's ability to deduce. Not being the first to write on this topic. The research also aims to: Apply some of Najmuddin al-Tawfi's choices; to facilitate access to their generality. Knowing the evidence on which Najmuddin al-Tawfi relied in his choices. Comparing the opinions of Najmuddin al-Tawfi and the jurisprudential opinions of other schools of thought. Limiting the points of agreement and disagreement of Najmuddin al-Tawfi, may God have mercy on him, for his Hanbali school of thought through induction of the issues. The research reached a set of results, including: al-Tawfi followed the method of abbreviation and conciseness. He commented on the hadiths in a manner appropriate to the situation, in a clear style. He worked on shortening the chains of transmission, for the purpose of facilitation and preservation. He mostly adhered to the text of Al-Tirmidhi. He used the linguistic element to remove ambiguities. Al-Tawfi has a mind free from sectarianism. Al-Tawfi is not biased towards the Hanbali school of thought. | ||||
