| Abstract | ||||
| إن الأطباء هم بشر قد يصيبون وقد يخطئون، والخطأ البشرى هو أمر وارد الحدوث ليس فقط في المجال الطبي، ولكن في جميع مجالات الحياة، وانطلاقا من تلك الرؤية هدفت الدراسة الحالية إلقاء الضوء على جريمة الأخطاء الطبية، من حيث: خصائص المجني عليهم والأطباء المشكو في حقهم، وماهية المستشفيات المبلغ عنه، والتخصصات الطبية، وأنواع الأخطاء الطبية، ومدى جسامتها، وأركانها، وكيفية إثباتها، والمدة الزمنية المستغرقة في جرائم الأخطاء الطبية، وانعكاس ذلك على كلا من المريض وأسرته والطبيب، وذلك من منطلق التوازن بين حقوق الطبيب وحقوق المريض كمحاولة لتحليلها وتفسيرها في ضوء نظرية العدالة ل "جون رولز". واعتمدت الدراسة على تحليل مضمون لبعض قضايا الاخطاء الطبية وبلغ عددها (26 قضية). وتوصلت نتائج الدراسة الى ان نسبة توجيه الاتهام للأطباء في القضايا الجنائية محل الدراسة، جاءت نتيجة إخلالهم الجسيم بما تفرضها عليهم أصول مهنة الطب لم تتعد (31%) من إجمالي القضايا – محل الدراسة-، وهذا يعنى ان هناك (69%) من القضايا المحررة من الشاكي لم تكن من وجود خطأ طبي او قصور او اهمال في حق المشكو في حقه، وان ما حدث للشاكي من تدهور لحالته الصحية كان من المضاعفات الصحية الوارد حدوثها والتي لا يمكن التحسب لها ولا الاحتراز منها ولا منع حدوثها. Doctors are people who may be right or wrong, and human error is possible not only in the medical field, but in all areas of life. Based on this vision, the current study aimed to shed light on the crime of medical errors, in terms of: the characteristics of the victims and the doctors against whom the complaint was filed, the nature of the hospitals reported, medical specialties, types of medical errors, their seriousness, how to prove them, the time period taken in medical errors crimes, and their impact on both the patient, their family and the doctor, based on the balance between the doctor's rights and the patient's rights as an attempt to analyze and interpret them in light of John Rawls' theory of justice. The study relied on a content analysis of some medical errors’ cases, the number of which amounted to (26 cases). The results of the study concluded that the percentage of accusations against doctors in the criminal cases under study, because of their serious breach of the principles of the medical profession imposed on them, did not exceed (31%) of the total cases under study. This means that (69%) of the cases filed by the complainant were not due to medical error, deficiency or negligence on the part of the defendant, and that what happened to the complainant in terms of deterioration in their health condition was one of the health complications that may occur and that cannot be anticipated, guarded against, or prevented. | ||||
