Abstract | ||||
Judicial protection is one of the most important guarantees and safeguards for protecting public freedoms in general, and freedom of opinion and expression in particular. An individual's right to express their opinion cannot be exercised properly unless there are fundamental guarantees to ensure it. Among the most critical of these guarantees is judicial protection for freedom of opinion and expression, as judicial oversight over how this freedom is exercised serves as a key factor in its protection. In addition to this crucial guarantee for safeguarding freedom of opinion and expression, there are several other guarantees that enable individuals to exercise their right to express opinions appropriately. These include the principle of legality, which provides special protection for freedom of opinion and expression, and public opinion, which reacts to any violations of this freedom. Furthermore, the principle of separation of powers plays a vital role in preventing any authority from encroaching on the jurisdiction of another. Despite the significance of these guarantees, judicial oversight remains one of the most important mechanisms for ensuring the proper exercise of freedom of opinion and expression. | ||||
