Abstract
يتناول هذا البحث الإشكاليات القانونية التي يثيرها الذكاء الاصطناعي أمام أنظمة الملكية الفكرية، التي تأسست على مبدأ أن الإبداع والاختراع فعل إنساني خالص، ويركز على النظام المصري للملكية الفكرية الذي يمثل القانون رقم 82 لسنة 2002 أساسه التشريعي في حماية براءات الاختراع والعلامات التجارية وحقوق المؤلف والأصناف النباتية، إلا أن هذا القانون، شأنه شأن الاتفاقيات الدولية مثل برن وتريبس، لا يتضمن نصوصا تنظم المخرجات الناتجة عن الذكاء الاصطناعي، مما يترك فجوة تشريعية واضحة تتعلق بتحديد صفة المؤلف أو المخترع، وتحقق الأصالة والجدة، وتوزيع المسؤولية عن الأضرار أو التعديات.
وعلى الصعيد المقارن، يبرز اتجاهان دوليان رئيسان، الأول في الولايات المتحدة والاتحاد الأوروبي، و يشترط المساهمة البشرية كأساس للحماية القانونية، رافضا الاعتراف بالآلة كمؤلف أو مخترع.
 أما الثاني، في المملكة المتحدة وإيرلندا، فيمنح حماية محدودة للأعمال المنتجة بالحاسوب، بنسبتها إلى الشخص الذي أعد الترتيبات اللازمة لإنتاجها، وهو اتجاه أكثر مرونة لكنه محدود النطاق، بينما تتبنى الصين واليابان نهجاً وسطاً يسمح بالحماية عند إثبات وجود مساهمة بشرية جوهرية.
ويخلص البحث إلى ضرورة أن يتبنى المشرع المصري رؤية شاملة تتجاوز تعديل النصوص، لتشمل إنشاء مراكز متخصصة للملكية الفكرية والذكاء الاصطناعي، ودعم الابتكار وريادة الأعمال، وتدريب القضاة والفاحصين، وتعزيز التعاون الدولي، فالتحدي الأكبر في المستقبل هو قدرة التشريعات على مواكبة واقع لم يعد فيه الإبداع حكرًا على الإنسان، بل أصبح ثمرة تفاعل بين الإنسان والآلة.
 
This research addresses the unprecedented legal challenges posed by artificial intelligence (AI) to intellectual property systems, which have traditionally been founded on the premise that creativity and invention are purely human acts. It focuses on the Egyptian intellectual property framework, in which Law No. 82 of 2002 serves as the main legislative foundation for protecting patents, trademarks, copyrights, and plant varieties. However, like international agreements such as the Berne and TRIPS Conventions, this law contains no explicit provisions governing AI-generated outputs, leaving a clear legislative gap concerning the identification of the author or inventor, the assessment of originality and novelty, and the allocation of liability for damages or infringements.
On a comparative level, two major international approaches emerge. The first, in the United States and the European Union, requires human contribution as a prerequisite for legal protection, rejecting the recognition of machines as authors or inventors. The second, followed in the United Kingdom and Ireland, grants limited protection to computer-generated works by attributing authorship to the person who made the necessary arrangements for their creation — a more flexible yet narrowly applied approach. Meanwhile, China and Japan adopt a middle ground, allowing protection when substantial human input can be demonstrated.
The study concludes that the Egyptian legislator must adopt a comprehensive vision that goes beyond mere textual amendments. This includes establishing specialized centers for intellectual property and AI, supporting innovation and entrepreneurship, training judges and examiners, and strengthening international cooperation. The greatest challenge for the future lies in the ability of legal systems to adapt to a reality in which creativity is no longer the sole domain of humans but a dynamic interaction between human and machine.
